JUDGMENT

When this case was called for hearing, Counsellor Cooper W. Kruah of Henries Law Firm appeared for appellant. Counsellors Cyril Jones and Nancy Sammy of Jones & Jones Law Firm appeared for appellee.

Having carefully reviewed the records, heard the arguments and contentions advanced by the counsels representing both parties and considered the laws cited and relied upon, it is hereby

ADJUDGED:

That the judgment entered by the Debt Court of Montserrado County dismissing the appellant’s action is hereby reversed. That as the actions of the parties in this case made the nature of the transactions between them difficult, cumbersome and complicated, if not impossible to decide in court without the assistance of a referee, this Court hereby directs, in the interest of justice, that the parties proceed back to the Debt Court of Montserrado County with the instruction that the Debt Court instructs the parties to select an auditing firm acceptable to both parties to conduct a comprehensive audit of the rice transactions between them. All parties shall fully cooperate with the audit and comply with the results thereof. The report of the audit shall be submitted to the Debt Court of Montserrado County and that court shall use the audit report as a guide in reaching a final decision in this case. The Clerk of this Court is ordered to inform the Debt Court of Montserrado County to resume jurisdiction over this case and give effect to this judgment. Costs to abide final determination. IT IS SO ORDERED.
