JUDGMENT WITHOUT OPINION. Decided June 8, 1973.* James G. Bull for appellants. R. F. D. Smallwood for appellees. At the call of this case counsellor James G. Bull appeared for the appellants, and counsellor R. F. D. Smallwood appeared for the appellees and filed a motion to dismiss the appeal on the grounds that the notice of completion of appeal attached to the appeal documents in the case pending before the Supreme Court does not relate to the case before this court, but the file numbers relate to a case of damages. Therefore, since the case before this Court on appeal lacks a notice of completion of appeal, the Supreme Court lacks jurisdiction over it in keeping with a long line of opinions. After considering and hearing argument on the motion to dismiss and on the resistance thereto, it is adjudged that the appeal be and the same is hereby dismissed, without prejudice to the parties to refile and replead in the court below if they so elect. The Clerk of this Court is ordered to send a mandate to the court below informing the judge therein as to the effect of this judgment. Costs are disallowed.
