JUDGMENT WITHOUT OPINION. Decided February 2, 1973.* 0. Natty B. Davis for appellant. Barnes for appellee. Solicitor General When this case was called, counsellor 0. Natty B. Davis appeared for the appellant and Solicitor General Roland Barnes appeared for the appellee. Counsel for the parties gave notice that they had agreed that a remand of the case was necessary and asked the Court to grant their request contained in an application signed by counsel for both sides. In view of the application made by appellant and appellee, it is adjudged that the application as filed be and the same is hereby granted, and this case remanded to the court below for a new trial. The Clerk of this Court is ordered to send a mandate to the trial court commanding it to resume jurisdiction and give effect to this judgment. � The Chief Justice and Justices Henries and Azango disqualified themselves herein for participation in the case prior to appointment to the Supreme Court.
