JUDGMENT WITHOUT OPINION.

At the call of this case, Counsellor Roger K. Martin of the Martin Law Office appeared for the plaintiff-in-error and Counsellor Arthur K. Williams appeared for the defendant-in-error.

 

After consideration of the facts and circumstances of the case and the law controlling, it is hereby adjudged:

 

1. That the ruling of the trial judge is hereby reversed and the case remanded.

 

2. That the trial judge will cause a notice of assignment to be issued citing the parties before going into the case. Costs are assessed against the defendant-in-error.
