When this case was called for hearing, counsel for appellee filed a motion for the dismissal of appellant’s appeal for late filing, to which counsel for appellant conceded. After consideration the motion to dismiss appellant’s appeal as filed, it is hereby ADJUDGED that the motion to dismiss be, and the same is hereby granted with costs againt appellant. And the clerk of this Court is ordered to send a mandate to the lower court informing it of this judgment. And it is hereby so ordered.
