When this motion was called for hearing Counsellor Stephen B. Dunbar, Jr. appeared for the movant and no one appeared for the respondents.

 

After a careful study of the records in the case filed and there being no appeal bond and notice of completion of appeal as alleged in the motion, it is hereby adjudged, that the motion be, and the same is hereby granted, and the appeal dismissed. The Clerk of this Court is ordered to strike this action from the docket of the Supreme Court and to send a mandate to the court below commanding the judge presiding therein to give effect to this judgment. Costs are ruled against respondent. And it is hereby so ordered.
