Passed at their First Session which was begun and held at the City of Monrovia, County of Montserrado, the Second Monday in October A. D. 1947 and adjourned without day on the 30th day of January A D. 1948.

CHAPTER I

AN ACT APPROVING THE STATEMENT OF UNDERSTANDING ENTERED INTO ON THE THIRD DAY OF SEPTEMBER A.D. 1947 BY AND BETWEEN THE GOVERNMENT OF THE REPUBLIC OF LIBERIA, HEREIN AFTER CALLED THE “GOVERNMENT” AND THE STETTINUS ASSOCIATES, INC., AND INCORPORATING “THE LIBERIA COMPANY.”

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, the Statement of Understanding made and entered into by and between the Government of the Republic of Liberia herein called the “Government” and the Stettinius Associates, Inc.,

dated the 3rd day of September, A. D. 1947, which said Statement of Understanding is appended hereto and made a part of this Act as if fully recited and set out therein, be and the same is hereby approved.

Section 2. That from and immediately after the passage of this Act, the corporate Charter of the Liberia Company, which said Charter is appended hereto and made a part of this Act as if fully recited and set out herein is hereby approved and made effective.

Section 3. That this Act shall take effect immediately and be published in hand-bills.

AN ACT TO REVIVE AND RENEW THE FRANCHISE GRANTED THE LIBERIA INTERNATIONAL AIR- WAYS.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That the Franchise granted to the Liberia International Airways, having lapsed before the Corporation could conclude its arrangements and begin operations, due to reasons beyond its control; the said Franchise is therefore hereby revived and renewed and the Company is hereby granted one (1) Calendar year from the date of the publication of this Act to begin operations.

Section 2. The revival and renewal of the Franchise to the Company revives and renews all of the rights, privileges and benefits granted to the Company by the Act incorporating it.

When effective

Section 3. This Act shall take effect immediately and be published in hand-bills.

CHAPTER III

AN ACT TO AUTHORIZE THE PRESIDENT OF THE REPUBLIC OF LIBERIA TO MAKE NECESSARY ARRANGEMENTS AND REGULATIONS TO CONTROL THE OPERATION OF THE PORT AND PORT WORKS.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, the President of the Republic of Liberia is authorized and empowered to make and publish any and all regulations necessary for the control of the operation of the Port and Port Works at Bushrod Island near Monrovia.

Section 2. All regulations made under the provisions of this Act shall be binding and operative to all intent and purposes as law, but they shall be submitted to the Legislature at their next ensuing Session for Legislative action.

Section 3. The President is further authorized and empowered to conclude agreements for the Port Management as may be necessary and in keeping with the terms of the Port Construction Contract: and all agreements made by the President with a Port Management Company shall be effective as law until the next meeting of the Legislature and the same shall be laid before them for Legislative action.

Section 4. This Act shall take effect immediately and be published in hand-bills.

CHAPTER IV

Dec,22,1947 S.7.

AN ACT TO REGULATE A TRADE SYSTEM WITHIN THE REPUBLIC.

Preamble

Whereas, for the purpose of the economic progress of the citizens of the Republic of Liberia, the regulation of a trade system has become a vital necessity; and

Whereas, in order to afford employment for and the development of Liberian Traders, and to avoid further hardship and disadvantage to the citizens and people of the Country this measure is necessary, therefore:

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, only such alien persons, firms or corporations who are importers and exporters within the Republic of Liberia, and who or which carry on wholesale trade in goods, wares and merchandises or other commodities, or export Liberian products shall be entitled to carry on retail trade within their principal place of establishment or main store through foreign employees.

Section 2. That said alien persons, firms or corporations may, nevertheless, establish and carry on retail business in any other part of the Republic, including the hinterland districts, only through Liberian agents and employees.

Section 3. No alien, alien firm, or corporation who or which is not an importer and wholesale merchant shall carry on retail trade in any part of the Republic, through alien, agents or employees, except at their main store establishment at legally authorized Ports of Entry.

Section 4. Any alien, alien firm or corporation violating the provisions of this Act shall be deemed guilty of a misdemeanour and shall be fined in a sum not exceeding two thousand dollars ( 2,000,00,() and the agent or other representative shall be subject to immediate deportation from the Republic. And any Collector of Internal Revenue or other Officer charged with the issuance of trading license, who shall issue a retail trading license to any alien, alien firm or corporation otherwise than as provided by this Act, shall be guilty of official misconduct and shall be immediately dismissed from office.

Section 5. This Act shall take effect immediately and be published in hand- bills.

CHAPTER V

AN ACT ABOLISHING THE BUREAU OF TRIBAL AFFAIRS OF THE INTERIOR DEPARTMENT AND CREATING THE POST OF ASSISTANT SECRETARY OF THE INTERIOR, R. L.

Whereas, in view of the creation of the post of Provincial Commissioner there would seem to appear certain conflict in the functions of the Chief of the Bureau of Tribal Affairs with said Official, and in order to regulate the duties and scope of functions of Provincial Commissioner for better administrative control and supervision in keeping with the true purpose and intent of the spirit of the laws relating to the Interior administration;

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, the Bureau of Tribal Affairs

created in the Interior Department, be and is hereby aolished and all functions vested in the Officer known as the Chief of the Bureau of Tribal Affairs, discontinued.

Section 2. There shall be created in the Interior Department an Officer known and styled as Assistant Secretary of the Interior who shall be appointed by the President by and with the advice and consent of the Senate and whose tenure of office shall be at the pleasure of the President as in instances of all other Civil appointees.

Section 3. The Assistant Secretary of the Interior shall materially assist the Secretary of Interior in the discharge of his duties; supervise the work of the departmental staff and perform such other duties as may be delegated to him by law or by the Secretary of Interior. In the absence, death, resignation or removal of the Secretary of Interior, he shall have charge of the Department, and perform the duties of the Secretary of Interior as Acting Secretary of Interior until a new appointment is made or return of the head of the Department.

Section 4. The Salary of the Assistant Secretary of Interior shall be fixed by Budgetary appropriation in common with other employees of Government annually.

Section 5. This Act shall take effect immediately and be published in hand- bills.

CHAPTER VI

AN ACT INCORPORATING THE LIBERIAN RUB- BER PLANTERS ASSOCIATION OF THE REPUBLIC OF LIBERIA.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled.

Section 1. That from and immediately after the passage of this Act, C. L. Simpson President, M. A. Morris, Vice President, George A. Padmore, Secretary, Momolu S. Cooper, Assistant Secretary, C. G. Bryant, Treasurer, together with all persons that are members together with all other persons who may hereafter connect themselves with said Association and their successors in office, be and they are hereby declared a body politic and corporate under the name and style of “The Liberian Rubber Planters Association of the Republic of Liberia” and under this name may sue and be sued, plead and be implead in any of the Courts of this Republic having competent jurisdiction.

Section 2. The Primary Object of this Association is: (a) to serve as a Consultative body and Advisory Council to Liberians engaged in the planting, cultivating, collecting, preparing and selling of rubber; (b) to give mutual and moral support to all such interest of the members of this Association as relate to the planting, cultivating, collecting and selling of rubber; (c) to seeking to procure any right and privileges for the furtherance of the objects of this Association, and to protect such rights and privileges obtained from any source whatsoever.

Section 3. That the said Liberian Rubber Planters Association shall have the right to draw up from time to time such laws for the governance of the Association as may be deemed necessary.

Section 4. That the said Liberian Rubber Planters Association may own property, personal and real, to the value of Fifty Thousand (50,000.00) Dollars and

enjoy all and singular any rights and privileges to like bodies granted under the laws as made and provided. It shall have the right to adopt a Constitution, Bylaws, Rules and Regulations for the governance of said Association not repugnant to the Constitution and Statute Laws of the Republic of Liberia.

CHAPTER VII

Jan. 29, 1948 S. 11.

AN ACT GRANTING TO HONOURABLE C. L. SIMPSON, VICE PRESIDENT OF THE REPUBLIC OF LIBERIA, LEAVE OF ABSENCE FROM THE REPUBLIC.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Grant of Leave absence

Seetion 1. That from and immediately after the passage of this Act, Honourable C. L. Simpson, Vice President of the Republic of Liberia, be and he is hereby granted leave of absence to travel without the Republic of Liberia for a period not to exceed five (5) calendar months.

Time.

Section 2. That said leave of absence shall commence as from the date the Vice President shall leave the Country, and take effect during the year 1948.

CHAPTER VIII

AN ACT TO AMEND AN ACT ENTITLED: “AN ACT TO SECURE AND IMPROVE THE HEALTH OF THE PEOPLE OF THE REPUBLIC”.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. This Act shall be known and cited as the Contagions and Communicable Disease Control Act.

Section 2. The term “Medical Officer” shall include health Officers of Government stationed in every part of the Country, the Director of Public Health and Sanitation in Monrovia and private medical practitioners whose nominal fee shall be 300.00( per annum.

Section 3. That from and immediately after the passage of this Act, all school children of whatever class, grade or standard including colleagues, school teachers and professors in schools, of every kind and nature; all civil servants of the Republic as well as clerical and nonclerical employees serving in the employ of Government or private business concerns; all domestic servants (cooks, stewards, washermen) or any servants employed in the home or any private or public place, be required to submit to a physical examiner and blood test at least once a year and obtain a medical certificate of good health (i.e. for the contagious or communicable disease) by a medical officer until the diseased person is cured of such disease.

All such treatment, in case of indigents and persons earning less than ) 50.00( per month, shall be free of cost, and in case of school children, such examination and treatment shall also be free.

Section 4. That medical Officers shall be required to conduct examinations in the case above mentioned

free of cost and wherever and whenever necessary, shall administer free treatment at the designated clinics.

Section 5. That all Medical Certificates of Health issued without the City of Monrovia shall be registered in the locality or areas where examinations were performed and a report of all diagnosis of such cases shall be filed with the Bureau of Public Health and Sanitation.

Section 6. That a register of all persons applying for examination and examined and treated with diagnosis of the Medical Officer be kept, and in cases where treatment is to be administered to anyone, a notation, of such treatment with the cause of illness shall be entered in the register on the applicant’s personal chart and shall be treated as confidential.

Section 7. That any person within the meaning of this Act may submit to medical examination, but in all such cases, the Medical Certificates of the attending Physician shall be exhibited to and recorded in the office of the Local Health Officer of the Republic of Liberia.

Section 8. That the Head of each Department or Bureau, Presidents of Colleges, Principals or Head- masters of Schools, Directors, Managers, or Agents of private Business Concerns shall submit to the Medical Officer a complete list of employees, engaged in their service or in attendance at their school, to be supplemented, augmented or revised when other employees are engaged or further enrollment of students made.

Section 9. That both the male and female parties to an intended marriage contract applying to the Registrar of Marriages for a Marriage license shall, as a necessary pre- requisite, produce and exhibit to the Registrar of Marriages a Medical Certificate of good health (i.e. free of contagious or communicable disease) issued by a Medical Officer in not less than three days, nor more than twenty one days prior “to the issuance of any marriage license.

Section 10. Any Medical Officer who maliciously issues a false certificate of good health (i.e. free of contagious or communicable disease) to any person or persons for whatever reasons shall, upon recommendation of the Medical Board, be liable for the first offense to a fine in a sum not exceeding 50,000recoverablebeforeanyCityMagistratewithallJudiciaryrights;andforthesecondoffenseuponrecommendationoftheMedicalBoardbeliabletoafinenotexceeding \ 500,000 ; and any subsequent offenses suspension of his license not to exceed six months or a fine of 500,000(or both upon the judgment of the Circuit Court of the particular Jurisdiction.

Section 11. That any person or persons refusing or neglecting to submit to a medical examination and to procure a certificate of good health (i.e. free of contagious or communicable disease) within the meaning and intent of this Act, shall for the first offence be fined a sum not exceeding 5,000and,thesecondoffense,besidesbeingdischargedfromfurtheremploymentupontheadviceoftheMedicalOfficer,shallbefinedasumnotexceeding \ 20,000 .

AN ACT AMENDING AN ACT APPROVED JANUARY 22, 1946, ENTITLED “AN ACT AMENDATORY TO AN ACT ENTITLED: AN ACT AUTHORIZING THE PRESIDENT OF LIBERIA TO APPOINT A NATIONAL ECONOMY COMMITTEE OF THREE OR MORE PERSONS TO PROVIDE AGAINST PROFITEERING.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That Section 1 of the Act approved

January 22, 1946, be so amended to read as follows:

“That operation of the Act passed and approved January 9, 1942, be and the same is hereby extended until the return to normality of conditions which at present so adversely affect trade and economy.”

Section 2. This Act shall take effect immediately and published in hand- bills.

CHAPTER X

AN ACT TO AMEND THE LOAN AGREEMENT OF 1926 AS PERMANENTLY AMENDED IN 1945.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That the amended Loan Agreement between the Government of the Republic of Liberia, of the first part; Finance Corporation of America, a Corporation organized and existing under by virtue of the laws of the State of Deleware, United States of America, of the second part; and the National City Bank of New York, a National Banking Association organized and existing under the laws of the United States of America, of the third part, signed on the 12th day of December, 1947, by William E. Dennis, Secretary of the Treasury, on behalf of the Government of the Republic of Liberia. Baron H. Larabee Attorney- in- Fact, on behalf of the Finance Corporation of America, and N. B. Knox. Vice President, on behalf of the National City Bank of New York, United States of America, and approved by William V. S. Tubman, President of the Republic of Liberia, be and the same is hereby approved.

Section 2. This Act shall take effect immediately and be published in hand- bills.

CHAPTER XI

AN ACT TO AUTHORIZE THE SETTING UP OF A SPECIAL COMMISSION TO STUDY AND RECOMMEND MEASURES FOR A REVAMPING OF THE DEPARTMENTS AND BRANCHES OF GOVERNMENT.

Whereas, the volume of business of the Branches and Departments of Government have increased to the extent that the present organizations are becoming inadequate to insure efficient administrations,

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That the President be and he is hereby authorized and directed to set up a Commission of five (5) persons, two of whom to be members of the Legislature and one of the Judiciary, to study the present organizations and operations of the respective Branches and Departments of Government and to recommend a plan for the revamping and reorganization of the several Branches and Departments of Government.

Section 2. The Commission shall receive compensation for their services in such sums as may be arranged between themselves and the Government of Liberia.

Section 3. This Act shall take effect immediately and be published in hand- bills.

AN ACT TO LEVY A TEN PER CENT TICKET TAX ON TRAVEL TO POINTS OUTSIDE OF THE REPUBLIC.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from the first day of January, A.D. 1948, there shall be levied a tax of ten percent (10%) on the value of all tickets issued by companies, corporations, firms individuals or their agent engaging in the transportation of passengers by sea or by air to passengers travelling to points outside of the Republic of Liberia. The value of such tickets on which the tax is to be paid shall be the actual fare charged to the passenger. The tax shall be collected from both cabin and deck passengers on ships.

Section 2. The tax shall be collected from the passenger by the transportation company or individual at the time that the fare for passenger is paid, and shall be remitted monthly by the transportation company or individual to the Bureau of Revenues not later than twenty days after the close of each calendar month, and in a manner to be prescribed.

Section 3. The books of companies and individuals herein covered shall be opened to inspection, as applies to records pertaining to passenger traffic, by duly authorized officials of the Bureau of Revenues during business hours.

Section 4. Failure to pay the tax when due, or for making a false declaration, shall subject the offender upon conviction before a Court of competent jurisdiction to a fine of not less than $50.00 and not more than $500.00 at the discretion of the Court, and may moreover be restrained from engaging in business until the tax, plus the fine and Court Costs have been paid in full.

Section 5. This Act shall be published in hand- bills to take effect from the first day of January, A.D.1948.

CHAPTER XIII

AN ACT TO AMEND THE ACT RELATING TO NATURALIZATION PASSED AND APPROVED DECEMBER 14, 1938.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and after the passage of this Act, Section Six of the Legislature entitled “An Act Relating to Naturalization” passed at the Session, 1938, be and the same is hereby amended to provide that the President of Liberia is authorized and empowered to waive the probationary period in the case of any applicant or applicants applying for naturalization after filing his Declaration of Intentions and allow such applicant or applicants to become citizens immediately.

Section 2. This Act shall take effect immediately and be published in hand- bills.

CHAPTER XIV

A JOINT RESOLUTION OF THE SENATE AND HOUSE OF REPRESENTATIVES OF THE RE- PUBLIC OF LIBERIA IN LEGISLATURE AS- SEMBLED GRANTING LEAVE OF ABSENCE TO HIS EXCELLENCY WILLIAM V. S. TUBMAN, PRESIDENT OF LIBERIA, TO TAKE A HEALTH TRIP.

Whereas, the arduous laborious and strenuous

activities of His Excellency President William V. S. Tubman, for the past four consecutive years of his incumbency, and especially his unceasing mental and physical exertions during the Centennial Celebration, require and entitle him to a rest to ensure his continual good health, and,

Whereas, the Legislature of Liberia, in appreciation of his undivided, unceasing and administrative services, wishes for him a respite and deems it necessary pursuant thereto that he should take a health trip;

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Joint Resolution, His Excellency William V. S. Tubman, President of Liberia, is hereby granted leave of absence from Liberia for a health trip for a space of three months, commencing from the day he leaves this Capital on said trip.

Section 2. Resolved further, that the Secretary of the Treasury of the Republic of Liberia be and he is hereby authorized to pay all expenses which may be incurred in connection with this trip, up to Twelve thousand dollars ($12,000.00) from any money out of the Public Treasury not otherwise appropriated, under warrant of the President.

When effective Section 3. This Joint Resolution shall take effect immediately and be published in hand- bills.

CHAPTER XV

Jan. 30, 1948 H. 20. JOINT RESOLUTION TO GRANT ANNUITIES TO THE SURVIVING HEIRS OF THE SIGNERS OF THE CONSTITUTION OF THE REPUBLIC OF LIBERIA.

Whereas, it has been the policy of every civilized

docratic government to always revere the memory of those of her citizens, who by their singular patriotic acts made possible the establishment of the State. Therefore;

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That we do hereby, again for the people, re- declare our deep and undying appreciation and gratitude to those of our illustrious Sires who One Hundred years ago, for and on behalf of the people of this State, did make, sign and publish the Declaration of Independence and the Constitution of the Republic of Liberia:

Section 2. That as a further act of our appreciation during this Centennial Year of the Republic, it is here by enacted that the heirs of S. Benedict, H. Teage, Elijah Johnson, J. N. Lewis, Beverly R. Wilson, J. B. Grippon, John Day, Amos Herring, A. W. Gardiner, Ephraim Titter, R. E. Murray and Jacob W. Prout, Signers of the Declaration of Independence and Constitution of Liberia, from and after the passage of this Act, receive annually an annuity of Three Hundred Dollars ($300.00), said annuity to be enjoyed by each group of heirs of each of the Signers of the Constitution so long as any of their heirs or descendants shall live.

Section 3. The Secretary of the Treasury is hereby authorized to make payment of same under warrant of the President, out of any monies in the Public Treasury not otherwise appropriated.

Section 4. This Act shall take effect as from January 1, A. D. 1948.

AN ACT APPROVING EXPENDITURES MADE IN THE PREPARATION, OBSERVANCE AND CELEBRATION OF THE CENTENARY.

Preamble

Whereas, the President was authorized and empowered to make necessary arrangement for the celebration and observance of the Centenary of the Republic, and the Secretary of the Treasury having submitted a special Report on the said expenditures:

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That the expenditures so made and shown by the Special Report of the Secretary of the Treasury be and the same is hereby approved.

CHAPTER XVII

AN ACT TO CREATE A DEPARTMENT OF AGRICULTURE AND COMMERCE.

Preamble

Whereas, the rapid economic development of the country necessitates the proper correlation and coordination of the agricultural and commercial activities and greater control and supervision of those activities so as to insure the best interest of all persons engaged in any manner whatsoever in an agricultural pursuits throughout the country as well as to the Government of Liberia, Therefore;

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Authorization

Section 1. That from and immediately after the passage of this Act, the President be and is hereby empowered to create and establish a Department

in the Executive Branch of Government to be known as the Department of Agriculture and Commerce, the main function of which shall be:

a) The correlation and coordination of all activities of an agricultural and commercial nature.

b) To record, tabulate, regulate and control all the agricultural and commercial resources of the nation.

c) To supervise and control the purchase, import and otherwise obtain livestock, plants and other agricultural commodities from time to time for the proper and adequate development and improvement of the Agricultural resources of the Country.

d) To devise plans for assisting farmers technically in better and more modern methods of producing and marketing of crops.

e) To standardize and control the standardization of all agricultural and commercial commodities of the Country of whatever nature whether for local consumption or for export.

f) To survey, control and develop the forest.

g) To have the control of all labor for development and exploitation within the Republic of whatever nature.

h) To control and regulate all imports into and exports out of the Country.

i) To exercise all powers and perform all duties heretofore assigned the Bureaux of Agriculture, Labor and commerce.

Section 2. This Department shall be administered by a Secretary of Agriculture and Commerce, who shall be appointed by the President with the advice

and consent of the Senate and charged with the action and supervision of all functions of the Department as set forth in Section I Supra or as may from time to time be made for the effective operation of said Department.

Section 3. That the President be and is hereby further authorized to appoint with the advice and consent of the Senate an official to be known and styled Assistant Secretary of Agriculture and Commerce whose duties shall be mainly to direct and control all activities of the Department of a technical nature under the direction and supervision of the Secretary of Agriculture and Commerce. He shall be in charge of and direct all technical employees of the Department. He shall also, in addition, perform all such other duties as may be assigned him, and in the absence, resignation, removal or death of the Secretary of Agriculture and Commerce, he shall succeed to administer the affairs of the Department and perform the duties of the Secretary of Agriculture and Commerce until otherwise ordered.

Section 4. That the President be and is hereby empowered to establish such bureaux and agencies under the Department as shall be found necessary for the efficient operation thereof and for the full implementation of the provision of this Act.

Section 5. The Secretary of Agriculture and Commerce shall from time to time draw up such rules and regulations for the effective administration of the Department as he may deem best. Such rules and regulations to be approved by the President.

Section 6. That the salaries of the Secretary of Agriculture and Commerce, the Assistant Secretary of Agriculture and Commerce and other officials and employees of the Department shall be fixed from time to time in the general budget in common with other public servants of the Republic.

Section 7. This Act shall take effect immedi- ally and be published in hand- bills.

CHAPTER XVIII

AN ACT TO PROHIBIT AND DECLARE GAMBLING UNLAWFUL AND PIVOIDING FOR THE PUNISHMENT OF SAME.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, it shall be unlawful for any person or persons, club corporation or society to engage in the practice of the playing of any game or games involving chance or skill wherein bets, wages or stakes is an element, and the winning or losing of money or other thing of intensive value is a necessary and essential element, or to set up any apparatus, contrivance or device by which it is determined who is the loser or winner of any money or other valuable, or to cast or throw dice or play a card or cards for the purpose of determining who is or shall be the winner or loser of any money or thing of value; or to keep any house or other place for the purpose of engaging in any such game or games, or or the use of any apparatus, contrivance or dice or playing of a card or cards, the purpose of which is determined who is the winner or loser in such game or games, by such apparatus, contrivance or device of the casting of such dice or playing of such card or cards by which any person shall win or lose any sum of money or other thing of value.

Section 2. Any person or persons, club corporation or society who shall be guilty of the commission of any of the above acts shall be guilty of gambling; and shall be punished before any stipendiary Magistrate

or Justice of the Peace by a fine of not more than one hundred ($100.00) dollars.

CHAPTER XIX

AN ACT APPROVING THE BUDGET PRESENTED BY THE SECRETARY OF THE TREASURY, REPUBLIC OF LIBERIA, AND PROVIDING FOR THE EXPENSES OF THE GOVERNMENT FOR THE FISCAL YEAR JANUARY 1, 1948 TO DECEMBER 31, 1948.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, the Budget presented by the Secretary of the Treasury of the Republic of Liberia for the year 1948 be approved; and he is hereby authorized to meet the expenses of the Government from January 1, 1948, in terms mentioned hereunder, under warrant of the President of the Republic of Liberia.

Section 2. The Secretary of the Treasury is hereby authorized to apply the revenue of 1947 in excess of this budget for the purposes and in the manner provided in Section 3, paragraph “D” of the Supplemental Loan Agreement of 1944.

Section 3. The Secretary of the Treasury is hereby authorized to expend any revenues of 1947 in excess of this budget which are not otherwise appropriated or obligated and which under the provisions of Section VI, paragraph IV of the Supplemental Loan Agreement of 1944, are available for appropriation for general purposes of the Government in accordance with a supplemental Budget, approved

by the President, and prepared in the manner provided in the Loan Agreement of 1926, as amended for the preparation of the Annual Budget.

CHAPTER XX

AN ACT TO AUTHORIZE THE AI’POINTMENT OF AN EDUCATIONAL CONSULTANT TO BE ATTACHED TO THE DEPARTMENT OF PUBLIC INSTRUCTION.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, the President be and he is hereby authorized and empowered to appoint, with the advice and consent of the Senate, an Educational Consultant to be attached to the Department of Public Instruction whose duties shall be to:

a) Give the Secretary of Public Instruction professional advices along all lines of an over- all set- up of modern educational system.
b) Map a topographical arrangement of all school areas throughout the country.
c) Have constructional supervision of school buildings on order of varying educational requirements and requisite equipment.
d) Supervise required revision of the general curricula for the grade school, secondary educational and high branches of industrial and technical institutes of learning.
e) Undertake researches relating to education and statistic of school operation in all of the public and private activities in the country

as required by the Secretary of Public Instruction.

f) Regulate the various divisions and general educational and cultural activities of a national and international requirement within the entire scope of Liberian operations of schools and institutions of learning established by law of the country.

g) Perform all duties within professional range as may be assigned by the Secretary of Public Instruction or the President.

When effective

Section 2. This Act shall take effect immediately and be published in hand- bills.

CHAPTER XXI

AN ACT TO AMEND AN ACT ENTITLED AN ACT TO REGULATE ALL ELECTIONS IN THE REPUBLIC OF LIBERIA.

Preamb’

Whereas, the Act entitled an Act to Regulate All Elections in the Republic does not provide how Registrars, Sheriffs, Judges, Clerks, and other Officers of Election shall be selected: and,

Whereas, the Election Commission, under the provisions of said Act are constituted of three persons, which make it difficult, if not impossible, for them to know the citizens throughout the country in the respective voting precincts who are proper persons to effectively and efficiently perform the duties of Registrars, Sheriffs, Judges, Clerks, and other Officers of Elections;

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the

publication of this Act, Section 6 and 7, of the Act, entitled “An Act to regulate All Elections in the Republic of Liberia”; which define the appointing power of the Election Commission, of Registrars, Sheriffs. Judges, Clerks, and all other necessary Officers relating to said Act be, and the same are hereby amended to read as follows:

Section 6. The Mayors, or Commissioners of the several Districts, Municipalities, Townships, or Settlements, within the Republic of Liberia, shall recommend all persons to be appointed by the Election Commission as Registrars, Sheriffs, Judges, Clerks, and all other officers, as may be necessary to carry out the provisions of this Act.

Section 7. The election Commission may, during the absence or temporary incapacity of any Registrar or other Election Officer, upon the recommendation of the said local Executive officials, appoint a substitute to the duties of such officer or officers.

CHAPTER XXII

AN ACT TO CREATE REVENUE COURTS IN THE REPUBLIC OF LIBERIA.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, the President is hereby authorized and empowered to set up in each of the Counties of the Republic a Revenue Court in the Bureau and offices of Collector of Internal Revenues in each of the Counties except in Montserrado County where there shall be two Revenue Justices.

Section 2. The Revenue Justices shall receive the Salary of (400.00 each per annum in each of

the Counties except the County of Montserrado where because of the volume of business the salary of the Revenue Justice shall be 600.00$ per annum. The President shall also appoint a Constable for each of these Revenue Courts whose Salary shall be 200.00$ per annum, except in Montserrado County where, for the reason herein before stated, their salaries shall be 300.00$ per annum.

Section 3. The President is hereby authorized for the effective operation and administration of the Revenue Courts, to make rules and regulations therefor.

Section 4. The mode of procedure of the Revenue Court shall be the same as that of the Justice of the Peace. The said Revenue Court shall have the jurisdiction over all taxes except excise duty and licenses.

Section 5. This Act shall take effect immediately and be published in hand- bills.

That from and immediately after the passage of this this Act, 50 per centum of the Annuity of 500,00( granted the late Elkanah Monger, Retired Circuit Judge of the Third Judicial Circuit, Sinoe County, Republic of Liberia, be and the same is hereby transferred to Mary C. Monger his widow for her natural life.

Section 2. The Secretary of the Treasury is hereby authorized under Warrant of the President of Liberia to pay same out of any money in the public treasury not otherwise appropriated, in regular monthly instalments.

Section 3. This act shall take effect as from the first day of January in the year of our Lord, One, Thousand Nine Hundred Forty- eight (January 1, 1948).

Whereas Edward Alphonso Davies has petitioned the Legislature not to subject him to the two years condition mentioned in Section 6 of the Act relating to Naturalization passed and approved December 11, 1938, but to declare him a citizen of the Republic of Liberia; and

Whereas good and tangible reasons have been shown in said petition to warrant such actions on the part of the Legislature;

Section 1. That from and immediately after the passage of this Act, the Annuity granted unto the late Colonel Joseph E. Smith of Grand Bassa County, Republic of Liberia, in the sum Three Hundred Dollars ($300.00) per annum, be and the same is hereby transferred unto Mary Ann Smith, his widow by one third, and the remaining two thirds to Elkanah B. Smith, John Smith, Amelia Smith and William Smith, his minor children.

Section 2. That the Secretary of the Treasury is hereby authorized to pay the same under warrant of the President of the Republic of Liberia, out of any money in the public treasury not otherwise appropriated in regular monthly installments.

Section 1. That from and immediately after the passage of this Act, the Apostolic Church, Assemblies of Africa, Monrovia, Liberia, of which Reverend John A. Tobey, Founder and President Elder; Reverend Samuel B. G. Stepney, Pastor District Elder, Peter Manley, Samuel Sanso, District Elders, Grand Bassa County.

Elders: Reverend Joseph qua Weah, Charlie Williams, Moses Stevens, Charlie Johnson, John Davies, Daniel Dean, Wesley Anderson, Garmadeh, and Eddie Johnson, District Secretary;

Trustees: Joseph Gray, Joshua Jessee, John Bardue, Isaac Denta, Barpoo, Jacob Zachus, Elizabeth Stepney, Alena Manley, Sarah Sam. Martha Coffa, Garnie Walah, established at Monrovia, Kakata, Marshall, Interior Grand Bassa County, Little Cola, Grand Cola, Krun Coast, Interior Maryland County, are members together with their successors in office and all who may become connected with said Church, be and the same is hereby incorporated a body of the name and style of the “Apostolic Church, Assemblies of Africa”, and in that name

AN ACT TRANSFERRING A PORTION OF THE PENSION GRANTED BY THE NATIONAL LEGISLATURE OF LIBERIA TO THE LATE JOSEPH T. INNIS, OF GRAND BASSA COUNTY, TO HIS WIDOW CATHERINE D. INNIS.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, Two Hundred ($200.00) Dollars per annum of the pension granted the late Joseph T. Innis of the County of Grand Bassa by the National Legislature of the Republic of Liberia is hereby transferred to his widow, Catherine D. Innis, during her natural lifetime.

Section 2. That the Secretary of the Treasury be and he is hereby authorized, under warrant of the President of Liberia, to pay same out of money in the public treasury not otherwise appropriated, in monthly installments of sixteen 66/100 dollars.

Section 3. This Act shall become effective as from the first day of January A. D. 1948.

CHAPTER XXXI

AN ACT TO INCREASE THE PENSION OF ABRAHAM L. SCOTT, VETERAN OF THE WAR OF 1910.

Whereas, Abraham L. Scott was wounded in the War of Maryland County in the year 1910 and as a result of said wound was unable to work to support himself and his family and was pensioned the sum of 50.00$ per annum by the Legislature during its Session of 1910-11; and

Whereas, said sum of 50.00$ per annum, due to the high cost of living, is entirely inadequate for the support of the said pensioner and his family;

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act the pension granted Abraham L. Scott is hereby increased to 150.00$ per annum.

Section 2. And the Secretary of the Treasury be and is hereby authorized to draw for same annually in twelve equal monthly installments, under warrant of the President, out of any monies in the public treasury not otherwise appropriation.

AN ACT GRANTING THE BAPTIST MISSIONARY SUNDAY SCHOOL CONVENTION, GRAND BASSA COUNTY, REPUBLIC OF LIBERIA, BY AND THROUGH JOHN N. HORACE, PRESIDENT OF THE SAID CONVENTION, PRESIDING THEREOF EIGHT HUNDRED ACRES OF LAND WITHIN THE NUMBER ONE CHIFDOM, FOR THE PURPOSE OF MISSIONARY, EDUCATIONAL AND INDUSTRIAL PROGRAM.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, the Baptist Missionary Sunday School Convention, Grand Bassa County, Republic of Liberia, by and through John N. Horace, President thereof, be and the same is hereby granted eight hundred (800) acres of public land in the number one chiefdom as shown below for the purpose of expanding its Missionary, Educational and Industrial Program:

Grand Bassa County, No. 1 Chiefdom Barclayville 800 Acres.

Section 2. That the President of the Republic of Liberia be and he is hereby authorized to grant deds for the number of acres of public land as set out in Section 1 of this Act, out of any public land in the place mentioned above or any other place within the number 1 chiefdom, Grand Bassa County, Baptist Missionary Sunday School Convention by and through its President may select not otherwise encumbered.

Section 3. That the said John N. Horace, President of the Baptist Missionary Sunday School Convention of the County and Republic aforesaid and his successor in office shall hold and possess the aforementioned parcel of land as long as the said parcel is continuously used for the purposes herein set forth provided that the grantee commences operation within two years from the date of approval of this Act.

CHAPTER XXXIV

AN ACT GRANTING ANNUITIES TO E. BEATRICE ROSS AND KETURAH MASSAQUOI OF THE CITY OF MONROVIA, COUNTY OF MONTSERRADO.

Whereas, E. Beatrice Ross entered public service first as stamp agent of the Monrovia Post office in the year 1923 and was later transferred to the Department of Justice in the year 1933, wherea she has up to the present served as payroll and voucher clerk; thus having behind her an unbroken service record of twenty four years; and

Whereas, Keturah Massaquoi commenced her public career in the capacity of Filing Clerk in the Department of Justice in the year 1926, at which said post she now still remains, covering a period of twenty one years of faithful service; and

Whereas, the said E. Beatrice Ross and Keturah Massaquoi having during said long period of years rendered loyal and efficient service to the Government evidencing service records almost without parallel in the annals of Civil Service or organization of the Republic; and as the said E. Beatrice Ross and Keturah Massaquoi are now well, declining in health and strength as a result of ripe age and can no longer withstand such physical strain and exertions which their present public assignments entail and impose; and

Whereas, it is in harmony with good policy of Government to extend recognition and financial consideration to such worthy citizens on being retired from public service in order to afford them reasonable living comforts for the remaining portions of their natural lives; therefore,

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, E. Beatrice Ross and Keturah Massaquoi of the City of Monrovia, County of Montserrado, be and they are each granted an annuity in the sum of six hundred ($600.00) dollars to be paid in equal monthly installments of fifty ($50.00) dollars each during their natural lives.

Section 2. That the Secretary of the Treasury be and he is hereby authorized to pay same, under warrant of the President, and of any monies in the public treasury not otherwise appropriated.

Section 3. This Act shall take effect and become operative as from the first day of January A. D. 1948.

CHAPTER XXXV

AN ACT GRANTING TO THE REFUGE MISSION OF THE APOSTOLIC FAITH OF OUR LORD JESUS CHRIST OPERATING IN LIBERIA FOUR HUNDRED ACRES OF LAND IN THE KONGBA- GOLA CHIEFDOM, WESTERN PROVINCE, LIBERIAN HINTERLAND.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, the Refuge Mission of the Apostolic Faith of our Lord Jesus Christ, operating in Liberia, by and through Margaret Giles Johnson, Principal thereof, be and the same is hereby granted four hundred acres of land within the Kongba- Gola Chiefdom, Western Province, Liberian Hinterland, for religious, educational and industrial purposes.

Section 2. That the President of the Republic of Liberia be and he is hereby authorized to grant a deed for the four hundred acres of public land herein granted, out of any public lands in the aforementioned Chiefdom not otherwise encumbered.

Section 3. That the said Refuge Mission of the Apostolic Faith of our Lord Jesus Christ operating in Liberia, shall hold and possess the aforesaid tract of land as long as the said land is continually used for the purpose herein set forth, provided however, that the grantee commences operation within two years from the date of the approval of this Act, and that should said grant cease for three (3) years consecutively to be employed and used for the purposes herein specified, said land together with all the rights thereon and all buildings and appurtenances thereto belonging, shall revert to the Government of the Republic of Liberia without compensation.

CHAPTER XXXVI

AN ACT TO COMPENSATE ANGELINE E. JACKSON OF THE COUNTY OF GRAND CAPE MOUNT FOR SERVICE RENDERED THE GOVERNMENT OF LIBERIA.

Whereas, Angeline E. Jackson, of the County of Grand Cape Mount, was appointed as Registrar, in the Bureau of Labor, in the County of Grand Cape Mount, and did serve at the salary of ten dollars per month, or one hundred and twenty dollars per annum, faithfully and efficiently, and

Whereas, it is the policy of the Government to compensate public servants for services rendered; Therefore,

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of the Act, Angeline E. Jackson, of the County of Grand Cape Mount, is hereby compensated for services rendered to the Government of Liberia, in the amount of one hundred and thirty dollars ($130.00).

passage of this Act, the sum of one hundred and fifty dollars ($150.00) be and the same is hereby transferred to Rose Leonard, the widow of the late Colonel Edward W. Leonard, and his heirs Faster W. Leonard and Charlotte Leonard.

Section 2. That the Secretary of the Treasury, R. L., be and he is hereby authorized to pay same out of any money not otherwise appropriated, under warrant of the President of Liberia, in monthly installments of twelve dollars and fifty cents.

Any law to the contrary notwithstanding.

CHAPTER XXXVIII

AN ACT GRANTING THE PROTESTANT EPISCOPAL CHURCH IN THE MISSIONARY DISTRICT OF LIBERIA, BY AND THROUGH BRAVID W. HARRIS THEREOF AND HIS SUCCESSORS IN OFFICE ONE THOUSAND FIVE HUNDRED (1,500) ACRES OF LAND FOR EDUCATIONAL, INDUSTRIAL, AND AGRICULTURAL MISSIONARY PURPOSES.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled.

Section 1. That from and immediately after the passage of this Act, the Protestant Episcopal Church in the Missionary District of Liberia, by and through Bravid W. Harris, Bishop thereof and his successors be and is hereby granted one thousand five hundred (1,500) acres of land for the purpose of expanding its Educational, Industrial and Agricultural Missionary work, the said parcel of land situated East of the town of KOLLI, on he left side of the Public Highway, in the SUACOCO Clan of JORQUELLI Chiefdom, Gbarnga District, Central Providence, Liberian Hinterland.

Section 2. That the President of Liberia be and he is hereby authorized to grant deeds for the acreage

of public land mentioned in Section one (1) of this Act to the said Protestant Episcopal Church in the Missionary District of Liberia through Bravid W. Harris, Bishop thereof and his successors in office.

Section 3. That the said Protestant Episcopal Church in the Missionary District of Liberia shall hold and possess the aforementioned parcel of land as long as said land is used for the purposes herein set forth, and that should said land cease for two consecutive years to be employed and used for the purposes and service herein specified, said land together with all rights thereon and all buildings and appurtenances thereto belonging shall revert to the Republic of Liberia without compensation.

Any law to the contrary notwithstanding.

CHAPTER XXXIX

JOINT RESOLUTION REIMBURSING WALTER F. WALKER OF THE CITY OF MONROVIA. COUNTY OF MONTSERRADO.

Whereas, Walter F. Walker of the City of Monrovia, has sustained a loss in the sum of one thousand five hundred dollars ($1,500.00) in Liberian Government 3% Internal principally due to his absence from the country in the Consular service of the Republic in the United States of America at the time said Bonds were being redeemed and collected; and it being but fair that he should recover said loss:

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this joint resolution, Walter F. Walker of the City of Monrovia, County of Motserrado, be and he is hereby reimbursed in the sum of one thousand five hundred dollars ($1,500.00).

Section 2. That the Secretary of the Treasury is thereby authorized to pay the same under warrant of the President out of any money in the public treasury, not otherwise appropriated.

Any law to the contrary notwithstanding.

Section 1. That from and after the passage of this Act, the 1st Session of the 41st Legislature of the Republic of Liberia adjourns sine die on the 30th day of January A.D. 1948.
