Passed at their Fourth Session which was begun and held at the City of Monrovia, County of Montserrado, the Second Monday in October A. D. 1946 and adjourned without day on the 14th day of February A. D. 1947.

CHAPTER I
AN ACT AUTHORIZING THE PRESIDENT OF LIBERIA TO APPOINT A COMMISSION TO REVISE THE CRIMINAL CODE OF 1914 AND TO FORMULATE AND DRAW UP A CRIMINAL AND CIVIL CODE OF PROCEDURE FOR THE COURTS OF THE REPUBLIC OF LIBERIA.

Whereas the Criminal Code of Liberia needs certain revision and to be brought up to date in order to provide for developments in the Criminal law which have taken place since its publication; and

Whereas the need is felt for a Criminal and Civil Code of procedure for the governance of the Courts of the Republic; therefore

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That the President of Liberia be and

he is hereby authorized to appoint a Commission of three persons to revise the Criminal Code of Liberia of 1914 in order to provide for further developments in the Criminal law, and generally to provide all necessary revisions thereto.

Section 2. That the said Commission, in addition to revising the Criminal Code as it presently exists and to include therein any necessary new provisions, is hereby authorized to draw up and formulate a Criminal and Civil Code of procedure for the governance and control of procedure in the Courts of the Republic of Liberia; and thereafter to submit said revised Criminal Code and Criminal and Civil Code of procedure to the next Session of the Legislature for its approval and enactment into law.

Section 3. That the President of Liberia is hereby authorized to cause to be drawn from the Treasury a sum of money adequate to compensate the members of said Commission for their services to be rendered in revision aforesaid Criminal Code and drawing up of a Criminal and Civil Code of procedure.

Any law to the contrary notwithstanding.

CHAPTER II
AN ACT AMENDING AN ACT PROVIDING PROTECTION FOR THE ESTATES OF PERSONS DYING INTESTATE, AND TO ASSURE THE RIGHTS OF HEIRS AND CREDITORS IN SUCH ESTATES.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, Section 2 of the Act providing

greater protection for the estates of persons dying intestate, and to assure the rights of heirs and creditors in such estates, be and the same is hereby amended so as to read as follows:

The President, by and with the advice and consent of the Senate, shall appoint in each County, Territory and District of this Republic an officer to be styled Curator, who shall be attached to the Probate Court or other court authorized by law to administer intestate estates in which in the opinion of the court there is no responsible surviving widow, or heir to administer same; or where such widow, heir or creditor may apply for the administration of any intestate estates by said Curator; and in all intestate estates of all aliens dying within the County, Territory or District of such Curator; and whose term of office shall be during the pleasure of the President.

Section 2. That nothing in this Act nor the Act providing greater protection for the estates of Persons dying intestate, and to assure the rights of heirs and creditors in such estates passed and approved March 5, 1936, shall be taken to have abolished the office of administrator.

Any law to the contrary notwithstanding.

AN ACT LEGALIZING PROCLAMATION OF HIS EXCELLENCY THE PRESIDENT OF LIBERIA DATED FIRST OF FEBRUARY A.D.1945,ESTABLISHING THE DEPARTMENT OF PUBLIC WORKS AND UTILITIES.

Whereas in keeping with the Act of the Legislature granting unto the President of Liberia special emergency Powers for the duration of world War

Number two and six months thereafter, approved June 30, 1942, it became necessary and the President of the Republic of Liberia in the exercise of the power vested in him by said Act did proclaim and establish an additional Department of the Executive Branch of Government to be known as the “Department of Public Works and Utilities” to be administered by a Secretary of Public Works and Utilities; who was accordingly appointed by His Excellency the President, during the recess of the National Legislature;

Therefore it is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That the Proclamation of His Excellency the President implementing the Act of the Legislature as referred to in the preamble of this Act be and the same is hereby approved and shall have full force of law.

Section 2. This Act shall take effect immediately and be published in hand- bills.

CHAPTER IV
AN ACT CREATING THE OFFICE OF COMMISSIONER OF POLICE FOR THE REPUBLIC OF LIBERIA.

Whereas the existing Police Forces in the Republic lack that degree of training and coordination which is desired to bring them up to accepted modern standards. it is deemed necessary that the supervision, organization and control to them be put under one central head; therefore

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That the President be and is hereby

authorized to appoint an officer under the direct and immediate control of the Department of Justice who shall be styled Commissioner of Police, Republic of Liberia, whose duty it shall be to reorganize and train the Police of the Republic according to accepted modern standards. His salary shall be fixed by annual budgetary appropriation.

Section 2. Said Commissioner shall also be Superintendent of the Force at Monrovia until such time as the revenues of the Republic shall justify the separation of the two officers; and his headquarters shall be at Monrovia; wherefrom and at he shall direct, train and control units of the Force situated, and to be hereafter situated, at different points in the Republic.

Section 3. All units of the Police Forces in the Republic shall be subject to the assignments, orders, training, direction and control of said Commissioner.

Section 4. Said Commissioner shall draw up suitable regulations for the disciplining and governing of the Police Forces throughout the Republic, which regulations shall be passed by the Department of Justice with a view to determining their legal validity and shall be subject to approval by the President.

Section 5. Any law or parts of law in conflict with the provisions herein be and the same are hereby repealed.

Section 6. This Act shall take effect immediate- ly and be published in handbills.

CHAPTER V

AN ACT TO INCORPORATE THE LIBERIAN INTERNATIONAL AIRWAYS, LIMITED.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature Assembled:

Section 1. Name. That the Government of the Republic of Liberia, represented by the Postmaster General and/or any nationals as shall become members and H. Roy Penzell, H. Mat Adams, William Miller, E. F. E. Williams, Frederick M. Ryan, of the City of New York, U. S. A. and such other persons as may hereafter become associated with them; their successors, heirs and assigns, be and they are hereby declared a body politic and corporate under the name and style of the Liberian International Air- ways, Ltd., and henceforth shall be known and styled by that name, and by that name and style to remain and have perpetual succession, with authority to contract, sue and be sued, plead and be implead in any Court of this Republic having competent jurisdiction.

Section 2. Registered Office. The Registered Office of the corporation in the Republic of Liberia is to be located in the city of Monrovia, Montserrado County, Liberia.

Section 3. Powers. The Corporation shall be competent in law to hold property real and personal to the value of five ($5,000,000.00) million dollars with power to increase and augment the capital stock according as the business demands; and shall have the right in its corporate name to purchase or otherwise acquire land for the benefit of the corporation. and it may grant, lease, exchange, assign, transfer or otherwise dispose of any part or portion of its property to any person or persons, consistent with the Constitution of the Republic of Liberia, to promote the interest of the corporation.

Section 4. Franchise. The Corporation is hereby

granted a franchise to be the exclusive representative and designee of the Liberian Government in the field of National and international Air transportation and to fly the National Flag of the Republic of Liberia and as such to do the following acts and things:

(1) To conduct a commercial Airline Business in all its branches for transportation by air of passengers, mail, express, freight, money, bills, notes, bullion, securities, and goods, wares and merchandise of every kind and description, from any place or places in the Republic of Liberia to any place or places in the World.

(II) To carry mail of the Republic of Liberia and mail of other countries and to make contracts with the Liberian Government and the government of any other country with respect thereto; not inconsistent with the laws of the Republic of Liberia.

(III) To conduct any commercial business relating to transportation by air, by any means whatsoever, whether now known or hereafter developed and every kind of business having to do with airplanes, airships and flying craft of any and all kinds.

(IV) To conduct the business of transportation of passengers, mail, express, freights, money, bills, notes, bullion, securities and goods, wares and merchandise of every kind and description by motor car, railroad, steamship or other water craft, and to conduct the business of manufacturing goods, wares and merchandise of every kind and description relating to and for the successful operation of the airline.

(V) To do any and all things that may be profitable or expedient to undertake as herein set forth the objects, purpose and powers conferred by the laws of the Republic of Liberia as fully as natural persons might or could do, in any part of the world, as principals, agents, contractors, or otherwise, and either alone or in conjunction with others.

(VI) To maintain, purchase, operate, sell or

otherwise acquire airports, airdromes, landing fields and landing installations of all kinds and character. and to enter into contracts or agreements with individuals, partnerships, firms and corporations, States, Countries, towns villages, municipalities or other governmental units, whether domestic or foreign. for the installation, maintenance and operation of airports and all air navigation facilities connected therewith.

(VII) To purchase, lease, buy, sell, deal and trade in airplanes and aircraft of all natures and kind whatsoever, as well as any and all kinds and types of vehicles, mechanisms and devices now known or which may hereafter be discovered or invented for navigating the air, for purposes of pleasure, as well as for purposes of business and commerce.

(VIII) To construct, build, acquire, lease, maintain and operate, plants, works, offices, stations, depots, hangars, airports, aviation fields, especially at Bassa, River Cess and Sinoc, and all other conveniences and appurtenances appropriate to the business of the corporation.

(IX) To design, manufacture, assemble, build, repair, maintain, operate, own, lease, let, purchase, sell and deal in aircraft of every kind and description, by whatever power actuated, and by whatever agency or method sustained or stabilized, (including without limitation) balloons, dirigibles, aeroplanes, hydroplanes, hydroaeroplanes, and all kinds and types of vehicles, mechanisms, and devices now known or which may hereafter be discovered or invented for navigating the air, for purposes of pleasure, commerce, or otherwise; to build, acquire, maintain, own, operate, let, lease, sell and otherwise dispose of air navigation facilities of every nature and description, including (without limitation) landing fields, aviation fields, hangars, land lighthouses, storage space, systems of radio communications, aircraft repair stations, mooring masts, landing

buoys, airports, either land or water, plants, works, stations, depots and all equipment incidental to the proper maintenance thereof, and all other conveniences and appurtenances appropriate to any of its business, including restaurants, hotels, rest and recreation rooms of every nature and description, automobiles, buses and all other means of locomotion necessary and desirable for the transport of mail, passengers, freight, express, securities and articles of merchandise of every character whatsoever to and from airport.

(X) To apply for, obtain, register, purchase, lease or otherwise to acquire and to hold, use, own, operate and introduce and to sell, assign or otherwise dispose of any trade- marks, trade- names, copyrights, patents, inventions, improvements and processes relating to aircraft and air transportation used in connection with or secured under Letters Patent of the Republic of Liberia, or elsewhere.

(XI) To purchase or otherwise acquire real estate and leaseholds or any interest therein, as may be necessary for the purposes hereinbefore expressed, and to hold, own or improve, sell and deal in the same.

(XII) To purchase or otherwise acquire all or any part of the business, goodwill, rights, property and assets of all kinds and assures all or any part of the liabilities or any corporation, association, partnership or person engaged in any business included in the foregoing purposes and object.

(XIII) To acquire and take over as a going concern and to carry on the business of any person, firm, association or corporation engaged in any business which this corporation is authorized to carry on and in connection therewith to acquire the goodwill and all or any part of the assets and to assume or otherwise provide for all or any of the liabilities of the owner or owners of any such business.

(XIV) To enter into, make, perform and carry out contracts of every sort and kind which may be necessary or convenient for the business of this corporation, or business of a similar nature, with any person, firm, corporation, private, public, or municipal, body politic under the government of the Republic of Liberia, or any foreign government so far as, and to the extent that the same may be done and performed by corporations organized under the Laws of the Republic of Liberia.

(XV) To act as brokers, agents, special agents and adjusters in the business of placing, selling or dealing in any kind or class of insurance in any or all of its branches including marine insurance, fire insurance, life insurance, aviation insurance, accident and health insurance, fidelity insurance, insurance against loss by defaults, whether wilful or otherwise, in the fulfilment of contracts and insurance against loss because of fraud, theft, robbery or any kind of misconduct.

(XVI) Subject to the restrictions or limitations imposed by law to purchase or otherwise acquire, hold, own, sell, assign, transfer, mortgage, pledge, exchange or otherwise dispose of the shares capital stock, bonds, obligations or other securities or evidence of indebtedness of other corporations, domestic and foreign, and the goodwill, rights, assets and property of any and every kind or part thereof, of any person, firm, or corporation, domestic or foreign, and if desirable to issue in exchange therefor the stock, bonds or other obligations of this Company, and while the owner of such shares of the capital stock to exercise all rights, power and privileges of ownership, including the power to vote thereon; and for any and all lawful purposes, in the course of the transaction of the business and affairs of the corporation, to acquire real and personal property, rights and interest of every nature, and to execute and issue bonds, debentures and other negotiable or transferable instruments, and to mortgage or pledge any and all of the

property of the corporation; to secure such bonds, debentures or other instruments, upon such terms and conditions as may be set forth in the instrument or instruments mortgaging or pledging the same, or in any deed, contract or other legal instrument relating thereto, provided nevertheless that no such sale, exchange or other transaction of the nature referred to herein shall be allowed so as to create a complete change in the identity of the corporation from Liberian to foreign ownership; and for that purpose the capital stock of said corporation shall be manipulated as to vest

(XVII) To make, accept, indorse, execute and issue promissory notes, bills of exchange, bonds, debentures and other obligations, from time to time, for the purchase of property or for any purpose in or about the business of the company, and to secure the payment of any such obligation by mortgage, pledge, deeds of trust, or other legal instruments.

(XVIII) To sell, improve, manage, develop, lease, mortgage, dispose of or otherwise turn to account, deal in or deal with all or any part of the property of the Company.

(XIX) To do all and everything necessary, suitable and proper for the accomplishment of any of the purposes or the attainment of any of the objects or the furtherance of any of the powers hereinbefore set forth, either alone or associated with other corporations, firms or individuals, and to do any act or acts, thing or things, incidental or pertaining to, or growing out of, or connected with the aforesaid business, or powers, or any part or parts thereof, provided the same be not inconsistent with the law under which this corporation is organized.

(XX) In general, to carry on any other business in connection with the foregoing, and to have and exercise all the powers conferred by the laws of the

Republic of Liberia upon business corporations formed under these laws, and to do any or all of the things hereinbefore set forth to the same extent as natural persons might or could do in any part of the world.

(XXI) To train Liberian citizens in the knowledge of aviation, such as managers, pilots, mechanics, ground crews, dispatchers, meteorologists, radio operators and any other branch of Civil Aviation, and in general to give instruction and training in the art of aviation, navigation, installing, maintaining and repairing aircraft, aircraft engines and accessories of all description, and in connection therewith to own and operate machine shops, schools, laboratories and any and all other necessary adjuncts.

(XXII) The foregoing clauses shall be construed both as objects and powers and except where otherwise expressed, such objects and powers shall in no wise be limited or restricted by reference to, or inference from the terms of any other clause in these Articles of Association, but the objects and powers so specified shall be regarded as independent objects and powers, and it is expressly provided that the foregoing enumeration of specific powers shall not be held to limit or restrict in any manner the powers of the corporation.

Section 5. Capital Stock. The total number of shares of the stock which this corporation is authorized to issue is one million two hundred thousand (1,200,000) of which one million (1,000,000) shares shall be common stock of the par value of one dollar ($1.00) per share and two hundred thousand (200,000) shares shall be Special Stock of the par value of fifty cents ($0.50) per share Fifty- one percent of the total Capital Stock shall be vested in the Liberian Government and or its nationals, and forty- nine percent in United States nationals.

Section 6. Officers. The Corporation shall consist of a Chairman of the Board and President; Vice

President, Secretary and Treasurer, General Manager, Director of Economic Planning and Development, Chief of Operations, a Board of Directors consisting of not less than seven (7) nor more than fifteen (15) members, including the officers as may be created by the Articles of Association and by- laws which shall also provide for the mode and manner of the election of the officers, and define the duties thereof. The said officers shall transact all the business of the company.

Section 7. Loans. The Corporation may borrow money, and secure the same with any of its property.

Section 8. Imports and Exports. The Corporation shall import free from Customs duty all materials, tools, equipment and implements for the actual use of the Corporation.

Section 9. Commencement of operation. The Corporation shall begin its operations within six (6) months from the passage of this Act, otherwise, the same shall be a nullity, except the Legislature shall extend the time in which it may begin its operations.

Section 10. Articles of Association and By- laws. The Corporation shall adopt Articles of Association and By- laws which shall be enforceable in any court of competent jurisdiction of Liberia or the United States of America and the same may be repealed, amended, or supplemented whenever it seems expedient to the Corporation. The Corporation shall have a Seal.

Section 11. This Act shall take effect immediately and be published in hand- bills.

Any law to the contrary notwithstanding.

CHAPTER VI
A DECLARATORY ACT ON THE AMENDMENTS OF THE CONSTITUTION APPROVED DECEMBER 11. A. D. 1945, ADOPTED AT A CALL ELECTION HELD ON THE 7TH DAY OF MAY A. D. 1946.

Preamble

Whereas, certain amendments to the Constitution of Liberia were proposed and submitted to the people of the Republic of Liberia for adoption by virtue of the Joint Resolution which proposed amendments to the Constitution of Liberia, passed by the Legislature at its regular Session A. D. 1945 in accordance with the Constitution in such cases made and provided as found on page 3 of the Act of the Legislature in 1945 entitled “A Joint Resolution to amend Section 11 of Article one of the Constitution entitled Election and qualification of Voters.”

And Whereas, said amendments were voted upon at a Call Election held throughout the Republic on the 7th day of May 1946;

And Whereas, from the Returns from the election submitted to the Legislature of Liberia at its present Session, and upon due examination of said Returns, it doth appear that said amendments were duly adopted by a true and complete two- third Vote of the elections who voted at said Election.

Therefore, it is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Amendment

When effective

Session 1. That the Constitutional Amendment so submitted in the above cited Act of the Legislature are hereby declared adopted by the people of the Republic of Liberia, and the President of Liberia is hereby authorized to proclaim the same by public Proclamation throughout the Republic.

Session 2. That this Act shall take effect immediately and be published in hand- bills.

Any law to the contrary notwithstanding. Approved December 10. 1946.

CHAPTER VII
“AN ACT CREATING PICININCESS OF THE KROO COAST IN MARYLAND COUNTY INTO A TOWNSHIP.”

Whereas, the civilized inhabitants of Picininciness of the Kroo Coast District, in Maryland County, Republic of Liberia, have petitioned and intimated to the National Legislature of Liberia their desire to remove and dissociate themselves from the Tribal Authority of Picininciness and to establish a civilized Settlement within their Tribal Territory; and

Whereas, it is the policy of the Government to foster and encourage the civilized people of the aboriginal element by granting them, as far a practicable, a recognized form of local Government:

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, Picininciness in Maryland County, be and the same is hereby incorporated and declared a body politic and corporate under the name and style of the Township of Picininciness, Maryland County, Republic of Liberia, and by this name may sue and be sued placed and be implead in any of the Courts of this Republic having competent jurisdiction, and to enjoy all and singular the rights and privileges usually enjoyed by similar bodies corporate and politic.

Section 2. That the boundaries of the Township of Picininciness shall be all that portion or parcel of land in Picininciness now known as the boundary on the East side of Kmaela division line North East 4 miles Interiorward, Newakpo division line changed in a line with Newakpo division on line North West 2 miles, as the division line, thence in a line with Big Fish Farm division line on the West and South West 4 miles as the beach facing the Atlantic Ocean. South East 2 miles to the place of beginning.

Section 3. Nothing in this Act shall be construed to subordinate the Tribal Authority of Picinii- nices to the said Township Authority, nor shall the Tribal Authority in any way be permitted to interfere with the local Administration of the Township Authority.

CHAPTER VIII

AN ACT CREATING KAKATA IN THE CENTRAL PROVINCE A TOWNSHIP.
Preamble

Whereas the civilized inhabitants of Kakata, Central Province, Republic of Liberia, have petitioned and intimated to the National Legislature of Liberia their desire to establish a civilized settlement within their territory; and

Whereas it is the policy of Government to foster and encourage the civilized people of all communities by granting them, as far as practicable, a recognized form of local Government,

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, Kakata in the Central Province, be and the same is hereby incorporated and declared a body politic and corporate under the name and style of the Township of Kakata, Central Province, Liberia and by this name may sue and be sued, plead and be implead in any courts of this Republic having competent jurisdiction, and to enjoy all and singular the rights and privileges usually enjoyed by similar bodies corporate and politic.

Section 2. That the boundaries of the Township of Kakata shall be all of that portion or parcel of

lind commencing at the junction of the Du River, with northern boundary of the Firestone Plantations Company, to the left Bank of the Du River, thence to the place of commencement, all to contain not more than eight square miles.

Section 3. Nothing in this Act shall be construed to subordinate the tribal authority of Kakata to the said township authority, nor shall the tribal Authority in any way be permitted to interfere with the local administration of the township authority.

CHAPTER IX
AN ACT TO AMEND SECTION 1303, CHAPTER LXIV OF THE REVISED STATUTES OF LIBERIA RELATING TO INHERITANCE OF REAL AND PERSONAL PROPERTY

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act Chapter LXIV, section 1303 of the Revised Statutes of Liberia relating to real and personal property be and the same is hereby amended to read as follows:

Section 1303. Inheritance of – The property of every person, who shall die without devising the same, shall descend in manner following:

To lineal descendants in equal parts, and should any such descendant die before the intestate and leave children, the children shall share equally of the person dying.

In the event of an intestate dying, leaving no heirs of his body, said property shall ascend

to his parents or stirps in fee, in equal proportion, and if the parents die without conveying said property, then it shall descend to the heirs of the parents from whom the owner of the property descended; and if the parents should die before the intestate the property shall be inherited by the heirs of said parents.

If there should be no surviving parent or direct heirs of said parents, then said property shall descend to the collateral relatives of the intestate.

CHAPTER X

AN ACT TO AUTHORIZE THE PRESIDENT OF LIBERIA TO APPOINT A COMMISSION TO REVISE THE LAND LAWS OF THE REPUBLIC.

Whereas, it does appear that because of many uncertainties and confusions about private and public land holdings, it is expedient that a Commission be set up to study the Land Laws of the Republic and recommend such revisions as might be necessary.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of his Act, the President be and he is hereby authorized to set up a Commission of 3 (three) to study the Land Laws of the Republic and recommend such revisions as will clear all uncertainties and confusions of title and have the Laws brought up to modern standards.

Section 2. The Secretary of the Treasury is hereby authorized to pay from the public Treasury under warrant of the President of Liberia all expenses and

salaries that will be necessary for the prosecution of this work from money not otherwise appropriated.

Section 3. This Act shall take effect immediately and be published in hand- bills

CHAPTER XI

JOINT RESOLUTION APPROVING AN AGREEMENT CONCLUDED BETWEEN THE GOVERNMENT OF THE REPUBLIC OF LIBERIA AND THE LIBERIAN INSTITUTE OF THE AMERICAN FOUNDATION OF TROPICAL MEDICINE, INC.

Whereas, the Agreement entered into between the Government of the Republic of Liberia and the Liberian Institute of the American Foundation of Tropical Medicine, Inc., a Corporation organized and existing under the laws of the State of New York, U. S. A., as of the 11th day of November A. D. 1946; has by the Executive Government been placed before the National Legislature for approval; and

Whereas, the Legislature, after due consideration of said agreement, and observing the great benefits that would accrue to the country by this generous offer of Mr. Harvey S. Firestone, Jnr., as a memorial to his late father: Therefore,

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That the agreement as entered into and referred to in the first preamble of this Joint Resolution be and the same is hereby approved, and the President of Liberia is hereby authorized and empowered to give full force and effect to the provisions hereof, as set forth in the copy of said

Agreement appended to this Joint Resolution and made a part thereof.

Section 2. This Joint Resolution shall take effect immediately and be published in hand bills.

CHAPTER XII
JOINT ADDRESS OF THE SENATE AND HOUSE OF REPRESENTATIVES OF THE REPUBLIC OF LIBERIA TO HIS EXCELLENCY THE PRESIDENT OF LIBERIA REQUESTING THE REMOVAL OF HIS HONOUR EMMANUEL W. WILLIAMS, JUDGE OF THE CIRCUIT COURT FOR THE SIXTH JUDICIAL CIRCUIT, MONTSERRADO COUNTY FROM OF- FICE.

Whereas, His Honour Emmanuel W. Williams, Judge of the Circuit Court for the Sixth Judicial Circuit, Montserrado County, has evidenced qualities and attitudes indicating physical and mental affectations which unfit him for further performing the duties and functions of Judge of the court aforesaid,

It is resolved by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled, two thirds of the members of both Houses convening,

Section 1. That from and immediately after the passage of this Joint Address the President of the Republic be and he is hereby addressed and memorialized for the causes above set forth, to remove from office the aforesaid Judge Emmanuel W. Williams and appoint another in his stead.

Section 2. It is further resolved that this will constitute the Joint Address required by the Constitution and shall be presented to the President for his action thereon.

CHAPTER XIII
AN ACT TO MEMORIALIZE THOMAS J. R. FAULKNER
Whereas Thomas J. R. Faulkner introduced and installed in the Republic of Liberia the first electrical telephone and ice plants,

Therefore, it is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act to memorialize the contribution made by Thomas J. R. Faulkner to Science in Liberia, on the date and hour of the month of his death, which is the 2nd day of February, 6:30 o’clock p.m. of each and every year all electricity in the Republic of Liberia shall be extinguished for one minute.

Section 2. The President is hereby authorised to see the provision of this Act executed.

AN ACT TO AMEND AN ACT ENTITLED: THE ACT TO CREATE THE AREA KNOWN AS THE CITY CORPORATION OF GREENVILLE A COMMISSION GOVERNMENT, PASSED AND APPROVED NOVEMBER 29, 1937.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. On line two of the caption of the Act above referred to, after the letter “A” delete “Commission Government” and substitute therefor “Commonwealth District”.

Section 2. This Act shall take effect immediately and be published in hand- bills.

CHAPTER XV

AN ACT TO AUTHORIZE THE PRINTING OF THE THIRD VOLUME OF THE LIBERIAN LAW REPORTS.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled.

Section 1. The President of the Republic of Liberia be and he is hereby authorized to cause to be printed and published the third (3rd) Volume of the Liberian Law Reports.

Section 2. The Secretary of the Treasury is hereby authorized to pay, under warrant of the President of Liberia, all expenses that might be necessary to facilitate the printing and publication of the said 3rd Volume of the Liberian Law Reports, from money not otherwise appropriated.

Section 3. This Act shall take effect immediately and be published in hand- bills.

CHAPTER XVI

AN ACT AMENDING CERTAIN PROVISIONS OF THE CUSTOMS TARIFF APPROVED DECEMBER 16, 1940.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled.

Section 1. That from and immediately after the passage of this Act the articles of the Import list of Customs Tariff as hereunder enumerated shall be

chargeable with the duties specified in this Act, and shall be assessed accordingly.

CHAPTER XVII

AN ACT TO AUTHORIZE THE GOVERNMENT TO GUARANTEE RE- PAYMENT OF MORTGAGE LOANS ON REAL PROPERTY MADE BY ALIEN MORTGAGES.

Whereas there is need for capital in amounts sufficient to meet the needs of our expanding economy and it is believed that for the purpose of promoting building and other development, it is a measure of enlightened public policy to encourage the investment of foreign capital in loans secured by mortgages on real estate; and

Whereas while alien creditors may lawfully make loans on the security of real estate may become

mortgages and may take action by judicial or extra- judicial proceeding for the foreclosure of such mortgages, they may not bid in at foreclosure sale and acquire title to the mortgaged property because of the constitutional prohibition of alien land holding.

THEREFORE, to encourage investment of foreign capital in mortgages upon Liberian real property notwithstanding such disability.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. Any foreign person or foreign corporation may lend money to any Liberian citizen or Liberian private corporation or to any foreign corporation engaged in business in Liberia and the borrower or any person or corporation acting as surety or guarantor of the borrower may give security to the foreign lender for the repayment of such loan, and the interest thereon accruing, by mortgage upon any real estate or interest therein belonging to such borrower or to such surety or guarantor.

Section 2. All loans made as herein authorized may be for such period and upon such lawful terms and conditions and shall bear such interest, simple or compound, not to exceed the legal authorized rate, as may be agreed upon by the parties.

Section 3. All suits, actions, proceedings and rights now or hereafter available to any other mortgages for the probate and registration of mortgages, the foreclosure thereof, and the recovery of the amount due thereunder, or of any deficiency remaining after the foreclosure sale, except the right to bid in and acquire the mortgaged property at the foreclosure sale, shall be equally available to a foreign mortgagee.

Section 4. If the net amount recovered by the alien mortgagee upon the foreclosure sale of the mortgaged property shall be insufficient to repay the amount due upon, the loan plus accrued and unpaid interest, court costs, and taxes, if any, on the mortgaged property paid by the mortgagee, and if, within one year

from the date of the judicial confirmation of the foreclosure sale the mortgagee shall have been unable to recover the deficiency from the mortgager, or from his surety or sureties, if any, then and in that event the Republic of Liberia shall forthwith pay to the mortgagee the amount still due and unpaid upon the mortgage debit whatever arising from principal, interest, taxes or costs, and shall thereupon and thereby become subrogated to the right of the mortgagee to recover such deficiency from the mortgager, or from his surety, or sureties, if any; provided, nevertheless, that the obligation of the Republic to pay such deficiency, as herein provided, shall not be incurred or exist unless the mortgage loans shall have been approved in writing by the Secretary of the Treasury substantially as follows:

Whereas (name of borrower) desires to borrow from (name of lender), an alien person (or an alien corporation) the sum of (specify amount), lawful money of the Republic of Liberia, for the term of years from the day of 19 such loan to bear interest at the rate of per annum, and to be secured by mortgage upon real estate in the Republic of Liberia, all as shown by the copies of the promissory note of the said borrower (and his sureties, if any) and of the deed of mortgage to secure the borrower’s obligation hereunto appended and made a part hereof marked for identification exhibits A and B respectively.

Now, therefore, the said mortgage loan is hereby approved, on behalf of the Republic of Liberia, and in consideration of the making of said loan the repayment thereof is hereby guaranteed by the Republic of Liberia to the extent and in the manner authorized by the provisions of [title of this Act].

Seetion 5. Any differences which may arise as to the amount, if any, due from the Republic to any alien mortgagee under the provisions of this Act shall be determined by suit by the claimant pursuant to the provisions of Section 1401 of the Revised Statutes.

Section 6. This Act shall be known as the Alien Mortgage Guaranty Act of 1947 and it shall take effect immediately.

CHAPTER XVIII

AN ACT TO AMEND AN ACT, AMENDING AN ACT ENTITLED: “AN ACT AMENDATORY TO THE GENERAL EDUCATION ACT OF 1912,” APPROVED APRIL 5, 1944.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, the Act of Legislature entitled: “An Act to amend an Act entitled, An Act amendmentary to the General Education Act of 1912″ approved April 5, 1944″ is hereby amended as follows:

That Section 1, paragraph 3 of the above Act now being amended, be and the same is hereby amended to read:

The Secretary of Public Instruction prepare and enforce a general scheme of study for the kindergarten, primary, intermediate, and advanced divisions of Public Schools; and the said scheme of study shall constitute the minimum standard requirement in the schools shall conform to such regulations as he shall issue in relation thereto. The curriculum of every school, operating within the Republic, shall conform to the courses thus provided, and the text books prescribed by the Department of Public In

struction only shall be used in the Republic, provide that College or University shall have the privileges of selecting text books for the Collegiate or University courses; such selection shall be subject to approval of the Department of Public Instruction.

Section 2. That under the circumstances where any prescribed text books are out of print and cannot be obtained from the publishers, the Secretary of Public Instruction shall be and is hereby vested with authority to provide suitable substitutes for the same without affecting the basic contents of the general scheme and/or courses.

Section 3. This Act shall take effect immediately and be published in hand- bills.

CHAPTER XIX
AN ACT TO APPROVE THE CONVENTION ON THE PRIVILEGES AND IMMUNITIES OF THE UNITED NATIONS. ADOPTED BY THE GENERAL ASSEMBLY OF THE UNITED NATIONS ON 31TH FEBRUARY, 1946.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled;

Section 1. That from and immediately after the passage of this Act, the Convention on the Privileges and Immunities of the United Nations adopted by the General Assembly of the United Nations on the 13th February 1946 be and the same is hereby approved.

Section 2. That the President of the Republic of Liberia is hereby authorized and empowered to deposit instruments of accession on behalf of the Republic of Liberia, and to give effect to the terms of said Convention.

CHAPTER XX AN ACT APPROVING THE CONSTITUTION OF THE WORLD HEALTH ORGANIZATION OF THE UNITED NATIONS DONE IN NEW YORK, 22ND JULY 1946.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, the Constitution of the World Health Organization of the United Nations done in New York, 22nd July 1946, be and the same is hereby approved.

Section 2. That the President of Liberia is hereby empowered to make effective the provisions of the said Constitution of the World Health Organization of the United Nations done in New York, 22nd, July 1946, and deposit formal instrument of acceptance with the Secretary General of the United Nations.

Section 3. This Act shall take effect immediately and be published in hand- bills.

CHAPTER XXI

AN ACT TO AUTHORIZE AND EMPOWER THE PRESIDENT OF LIBERIA TO FULFIL THE OBLIGATIONS OF THE LIBERIAN GOVERNMENT UNDER THE CHARTER OF THE UNITED NATIONS AND IN PARTICULAR, ARTICLE 41 THEREOF.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, the President of Liberia is

hereby fully and completely authorized and empowered to fulfil in every respect the obligations of the Government of Liberia to the United Nations Charter, and particularly Article 41 thereof which reads as follows, to wit:

” The Security Council may decide what measures not involving the use of armed forces are to be employed to give effect to its decisions, and it may call upon the members of the United Nations to apply such measures. These may include complete or partial interruption of economic, radio, and other means of communication, and the severance of diplomatic relations”.

Section 2. This Act shall take effect immediately and be published in hand- bills.

CHAPTER XXIII

AN ACT APPROVING THE BUDGET PRESENTED BY THE SECRETARY OF THE TREASURY, RE PUBLIC OF LIBERIA. AND PROVIDING FOR THE EXPENSES OF THE GOVERNMENT FOR THE FISCAL YEAR JANUARY 1, 1947 TO DECEMBER 31, 1947.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1 That from and immediately after the passage of this Act the Budget presented by the Secretary of the Treasury of the Republic of Liberia, for the Year 1947 be approved; and he is hereby authorized to meet the expenses of the Government from January 1, 1947 to December 31, 1947, in terms mentioned hereunder, under warrant of the President of the Republic of Liberia.

Section 2. The Secretary of the Treasury is hereby authorized to apply revenues of 1946 in excess of this Budget for the purpose and in the manner provided in Section 3 Paragraph “D” of the Supplemental Loan Agreement of 1944.

Section 3. The Secretary of the Treasury is hereby authorized to expend any revenues of 1946 in excess of this Budget which are not otherwise appropriated or obligated and which under the Provisions of Section VI, Paragraph IV of the Supplemental Loan Agreement of 1944, are available for appropriation for general purpose of the Government in accordance with a Supplemental Budget, approved by the President, and prepared in the manner provided in the Loan Agreement of 1926, as amended, for the preparation of the Annual Budget.

CHAPTER XXIV
AN ACT TO AMEND “AN ACT TO PROVIDE AN INTERNAL REVENUE CODE OF THE REPUBLIC OF LIBERIA” APPROVED DECEMBER 11, 1937.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act Section 12 of Article 2 of the Act above referred to is hereby amended by adding after the world “Liberia” on line 3 (from top of the Section) the world “inhabited by Citizens or aliens.”

Section 2. That Section 19 of Article 2 of the aforesaid Act is hereby amended by adding after the word “therein” on line 8 (from top of the Section) the words “and all male aliens within the Republic of 21 years of age and above.”

Section 3. That Section 20 of Article 2 of the aforesaid Act is hereby amended after the word “inhabitant” on line 3 (from top of Section) the words “whether citizen or alien.”

Section 4. That Section 21 of Article 2 of the aforesaid Act is hereby amended by adding after the word “estate” on line 2 (from top of Section) the words “and all male aliens within the Republic of 21 years of age and upwards.”

Section 5. That Section 24 of Article 2 of the aforesaid Act is hereby amended as follows (counting from the top of Section):

(a) On line 1 after the word “Liberia” add the words “and all aliens residing within the Republic of Liberia.”

(b) On line 11 after the word “Citizen” add the words “or aliens.”

(c) On line 12 after the word “Citizen” add the words “or alien.”

(d) On line 23 after the word “Citizen” add the words “or alien.”

Section 6. That the amendments above made to the several sections of Article 2 of the aforesaid Act exclude all aliens of diplomatic status who by treaties, and all persons who by existing agreements, are exempt from the payment of such taxes.

Section 7. This Act shall take effect immediately and be published in hand- bills.

CHAPTER XXV
AN ACT TO AMEND AN ACT CREATING THE CIVIL LAW COURT OF THE SIXTH JUDICIAL CIRCUIT MONTSERRADO COUNTY, APPROVED MARCH 21, 1944.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of the Act, Section 5 of the Act creating the Civil Law Court of the Sixth Judicial Circuit, Montserrado County, shall be amended to read that said Civil Law Court shall hear and determine all appeal cases of a civil nature emanating from Courts of Magistrates and Justices of the Peace.

This Act shall take effect immediately and be published in hand- bills.

CHAPTER XXVI
AN ACT ABOLISHING THE POSITION OF SECRETARY OF THE POST OFFICE DEPARTMENT AND CREATING THAT OF ASSISTANT POSTMASTER GENERAL.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act the position of Secretary of the General Post Office Department as found in Section 1238 of the Revised Statutes be and the same is hereby abolished.

Section 2. Instead, there shall be acted in the

Post Office department the position of Assistant Postmaster General, who shall be appointed by the President, by and with the advice and consent of the Senate and shall receive salary in accordance with the annual budget.

Section 3. The duties shall be that of Chief of the permanent staff, and he shall materially assist the Postmaster General in the discharge of his duties and perform the duties formerly devolving upon the Secretary of the General Post Office; or such others as may by law be delegated to him or required by the Postmaster General. In the absence, death, resignation or removal of the Postmaster General he shall automatically succeed to the duties of the Postmaster General as Acting Postmaster General until the return of the Postmaster General or a new appointment is made.

CHAPTER XXVIII
AN ACT AMENDATORY TO AN ACT ESTABLISHING THE CIVIL SERVICE OF THE REPUBLIC OF LIBERIA AND PROVIDING FOR THE OPERATION THEREOF.

Whereas to give greater effect to the purpose, spirit and intent of the Act creating and establishing the Civil Service of the Republic of Liberia, it has become necessary to amend said Act, whereby deserving employees of the Government will be pro-

vided better opportunities and facilities for advancement, Therefore,

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That the whole of Section 1 be deleted and the following be substituted to read:

Section 1. “That there shall be established in the organization of the Government of the Republic of Liberia, under provision in the annual appropriation Act for the fiscal year, and for each succeeding year thereafter, an agency of Government to be styled “CIVIL SERVICE COMMISSION OF THE REPUBLIC OF LIBERIA”. The said Civil Service Commission shall be independent of all other departments of Government and the official appointed in charge thereof shall be subject only to the President of Liberia.

Section 2. That the whole of Section 10 be deleted and the following be substituted to read:

Section 10. The classification of the Civil Service of the Republic of Liberia, as provided in Section 9 of the Civil Service Act, shall be arranged in accordance with the following schedule:

Class 1. Employees of Government of whatsoever capacity whose annual salary is

( 600.00) six hundred dollars.

Class 2. Employees of Government whose annual salary is six hundred dollars
(
( 600.00) or more and less than nine hundred dollars
(
( 900.00) stenographers and book-keepers already in service with qualifications mentioned in Section 2 hereof shall be rated in this class.

Employees of Government whose annual salary is nine hundred dollars ($900.00) or more, and less than one thousand three hundred and fifty dollars $1,350.00) or more.

Class 4. Employees of Government whose annual salary is one thousand three hundred and fifty dollars ($1,350.00).

ADMINISTRATIVE CLASSES:
The Chief Clerks of Bureaux, Chief Clerks of Departments, Accountants, Audit and Revenue Inspectors, Chiefs of Bureaux not exempted under Section 9 of the Civil Service Act shall constitute the Administrative Class and shall be rated as follows:

Chief Clerks of Bureaux in Class 2, Chief Clerks of Departments, Accountants, Revenue and Audit Inspectors in Class 3, Chiefs of Bureaux within the classified service, as class 4.

Section 3. That the whole of Section 16 be deleted and the following be substituted to read:

Section 16. No person shall be admitted to civil service standing or certified as eligible for original appointment, unless he or she shall have passed a competitive examination, except graduates of Liberia College holding a Bachelor of Arts degree, and citizens of Liberia graduating from other recognized colleges and universities holding the same degree, who may be admitted to the service in class two without an Entrance Examination. Stenographers and Book- keepers holding certificates and diplomas from recognized schools of business, colleges and associations, may also enter the service in class two, following a special entrance examination which may not be competitive and no

employee shall receive promotion to a higher position in class than that occupied, unless he or she shall have established fitness for such promotion by examination, which examination need not be competitive. Employees desiring transfers, and former employees applying for reinstatement shall be required to qualify under examination before such transfer or reinstatement be made.

Section 4. That the whole of Section 26 be deleted and the following substituted to read:

Section 26. Any employee in the classified service may be separated from the service temporarily by suspensions or permanently by dismissal for just cause, or any reason enumerated in Section 15 of the Civil Service Act, at the discretion of the appointing officer; by retirement from service when the employee shall have served thirty (30) years in the classified service, it being understood that such an employee shall be placed on pension at the rate of one- third of the salary earned at the time of fifty- five (55) years shall also be retired. Provided, however, that an employee shall not be subject to suspension for a period exceeding ninety (90) days in any single instance, and that both retirement and dismissal from the service shall be first reported to the President through the Commissioner of Civil Service for his approval and confirmation.

During a period of suspension an employee shall receive no compensation for service. Copies of all records relating to the suspension, retirement or dismissal of an employee shall be filed in the office of the CIVIL SERVICE. In the case of se

paration from the service because of the death of an employee, his family or immediate relatives shall receive a special bonus of one month’s pay in the amount as was received by the employee before his or her demise.

Section 5. That the whole of Section 27 be deleted and the following substituted to read:

Section 27. Notice in writing shall be given by the appointing officer to the Commissioner of Civil Service, or any person or persons selected for probationary appointment, who shall also have issued to them a certificate of probationary appointment under the endorsement of the Commissioner of Civil Service; or of the rejection of any employee during, or at the termination of the period of probation; and to persons retained, the Commissioner shall issue a certificate of permanent appointment under the seal of his office. The appointing officer shall also give notice in writing to the Commissioner of Civil Service of promotions, transfers, resignations, and removals; the date thereof and reason therefor, and such notice shall be made a matter of record in the office of the Civil Service Commission.

Section 6. That the whole of Section 29 be deleted, as amended and the following substituted to read:

Section 29. Employees of the classified service shall be entitled to vacation and leave of absence with full salary according to the following schedule:

(a) Employees of Government whose annual salary is not less than $300.00 and not more than $600.00 shall be granted 14 days leave for every completed year of service, exclusive of Sundays and Holidays.

The Commissioner of Civil Service in collaboration with the heads of departments and independent bureaux, shall arrange leave schedules for each office and notify appointing officers and employees at least one month in advance of civil servants due for leave.

Additional leave of absence with or without salary on account of illness or other good cause, may, however, be granted for reasonable periods when not inconsistent with the need of the service and such employee having sick leave shall enjoy free medical care and free hospitalization at Government’s expense upon presentation of a certificate from the appointing officer, approved by the Commissioner of Civil Service to the Director of Public Health and Sanitation of this Republic, it being understood that free medication and free hospitalization will be granted only to such employees whose cases are diagnosed by competent medical authority as not to have been provoked by their own recklessness, excesses, indiscretion or moral turpitude on their part.

That the whole of Section 34 be deleted and the following substituted to read:

Section 34. No person in the classified service shall incur punishment by means of a fine, or by the withholding of any part of his or her salary for administrative offences except for tardiness and unauthorised absences from duty: in which case the appointing officer shall impose a fine of not more than (one twenty- fifth) of the monthly salary earned by the employee for each offence. The division of such salary or any part thereof, to others or for other purposes, for any reason whatsoever, unless in virtue of voluntary written authority of the employees concerned, is strictly prohibited. Punishments may be inflicted only by means of suspension for minor offences, fines for tardiness and unauthorised absences, or dismissal. Any officer or employee of the Government violating the provision of this Section will be subject to administrative action by the President.

Section 8. This Act shall take effect immediately and be published in hand- bills.

CHAPTER XXIX

AN ACT AMENDATORY TO “AN ACT PROVIDING GREATER PROTECTION FOR ESTATES OF PERSONS DYING INTESTATE, AND TO ASSURE THE RIGHTS OF HEIRS AND CREDITOR IN SUCH ESTATE,” PASSED AND APPROVED MARCH 5, 1936.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That Section one (1) of the Act of

Legislature, approved March 5, 1936, be amended in the following particulars:

(a) Instead of Section 1015 of the Revised Statutes as appears in Section one (1) of said Act, read “Section 1055”.

(b) Instead of the word “Established” as appears at the end of Section one (1) of said Act, read “Abolished”.

Section one (1) of the Act as aforesaid shall therefore read as follows:

“That from and immediately after the passage of this Act, the office of Administrator provided by Section 1055 of the Revised Statutes and the laws regulating the administration of Intestate Estates be and the same is hereby abolished,”

Section 2. Section nine (9) of the said Act of March 5, 1936, be amended to read as follows:

and same shall be collected by the sheriff of said court and deposited in the public treasury as revenue.

All fees of officers of court and other incidental expenses anent the administration of the estate shall be borne by said estate.

Section 5. This Act shall take effect as of February 1, 1947, and be published in hand- bills.

Section 1. That from and immediately after the passage of this Act, Section 3 of the Act of the Legislature of the Republic of Liberia, approved December 18, 1944, be and the same be so amended as to read: This Act shall be published in hand- bills to take effect from the first day of January A. D. 1945 up to and including December 31st, 1949.

CHAPTER XXXI

JOINT RESOLUTION OF THE SENATE AND HOUSE OF REPRESENTATIVES OF THE REPUBLIC OF LIBERIA RECOGNIZING THE INDEPENDENCE OF THE PHILIPPINE REPUBLIC.

WHEREAS, a Proclamation issued by the President of the United States of America on July 4, 1946,

declared the Commonwealth of the Philippines a separate and self- governing nation, and acknowledged the Constitution and control over the same of the government instituted by the people thereof under the Philippine Constitution; and

WHEREAS, by said Proclamation the United States did with draw and surrender all rights of possession, supervision, jurisdiction, control and sovereignty which it had exercised over the Philippine Archipelago under the terms of a subsequent Treaty of Peace between the United States of America and Spain, of December 10, 1898 commonly known as the Treaty of Paris, as well as under the terms of a subsequent Treaty with Spain on November 7, 1900; and by the Convention of January 2, 1930 between Great Britain and the United States, the boundary between the Philippine Archipelago and the State of North Borneo was delineated; and

WHEREAS, the invitation of the Government of the United States of America and the Government of the Commonwealth of the Philippines extended the Government of Liberia to be present at the ceremonies attending the Proclamation of the Independence of the Republic of the Philippines and the inauguration of Manuel Ricas as President and Elpido Quirinus as Vice President of the new Republic was accepted by His Excellency W. V. S. Tubman, President of Liberia; and in response to said invitation the Honourable J. A. H. Jones, President Pro- tempore of the Honourable the Senate of Liberia was designated and despatched as the personal representative of the President of Liberia in the quality of Envoy Extraordinary; and

WHEREAS, it doth appear to the Legislature, in keeping with democratic principles upon which this nation is established, as well as, it being the right of peoples, acknowledged by the Laws of Nations at all times to take upon themselves self- government,

that the independence of the Philippines should be recognized; now therefore,

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

SECTION 1. That the Republic of the Philippines be and is hereby acknowledged a separate and self- governing nation; and the government instituted by the people thereof under the Philippine Constitution be and is hereby recognized.

SECTION 2. That the President of Liberia is hereby empowered to proclaim to the people of Liberia the Independence of the Republic of the Philippines as a sovereign self- governing nation.

SECTION 3. That this Joint Resolution shall be published in hand- bills.

CHAPTER XXXII AN ACT TO AMEND THE CUSTOMS TARIFF OF 1940.

CHAPTER XXXIII

CONCURRENT RESOLUTION
Resolved by the Senate, (The House Concurring) That immediately after the adoption of this Con- current Resolution, there shall be established a joint committee on the organization of the Legislature (hereinafter referred to as the Committee) to be com- posed of five members of the Senate to be appointed by the President of the Senate, and six members of the House of Representatives to be appointed by the Speaker of the House of Representatives. The Committee shall select a chairman and Vice Chairman from among its members. No recommendation shall be made by the Committee except upon a majority vote of the members representing each House, taken separately.

Duties.

Section 2. The Committee shall make a ful and complete study of the Republic of Liberia and such other similar organizations local or foreign as shall to said committee appear to offer assistance in solving the problems presented as it performs the duties and service of it expected and shall recommend improvements in such organization and operation with a view towards strengthening the Legislature, simplifying its operations, improving its relationships with other branches of the Liberian Government, and enabling it better to meet its responsibilities under the Constitution. This study shall include, but shall not be limited to the organization and operation of each

House of the Legislature, the relationship between the two Houses; of the relationship between the Legislature and other branches of the officers and employees of the respective Houses, and other officers and employees of the committees and members of the Legislature; and the structure of, and the relationship between, the various Standing, Special and Select committees of the Legislature. Provided that nothing in this Concurrent Resolution shall be construed to authorize the committee to make any recommendation with respect to the consideration of any matter on the floor of either House; provided further that the language herein employed shall not prohibit the committee from studying and recommending the consolidation and re- organizations of committees.

Section 3. (a) The committee, or any duly authorized sub- committee thereof, is authorized to sit and act at such places and times during the sessions, recesses, and adjourned periods of the Fortieth and Forty- first Legislature, to require by subpoena or otherwise the attendance of such witnesses and the production of such books, paper and documents, to administer such oaths, to make such testimony, to procure such printing and binding, and to make such expenditures as it may seem advisable, and for which budgetary appropriation shall have been provided.

(b) The Committee is empowered to appoint and fix the compensation of such Experts, Consultants, Technicians, and clerical and stenographic assistants as it deems necessary and advisable, but the compensation so fixed shall not exceed the budgetary appropriation.

(c) The expense of the Committee shall be included in the Annual Budget for 1947.

(d) The Committee shall report from time to time to the Senate and the House of Representatives the result of its study, together with its recommendations. The first report shall be made to the First Session of the Forty- first Legislature.

AN ACT TO CREATE THE EIGHT, NINTH AND TENTH REGIMENTS IN THE MILITIA OF THE REPUBLIC OF LIBERIA, AND FIXING THE TIME AND PLACES OF THEIR RESPECTIVE PARADES.

Whereas, it has become evident that the number of soldiers of the Kroo Coast Detachment in Maryland County, and the Detachment at Nyaake, Webb, in District Number I, Eastern Province, Liberian Hinterland, and these being units attached to the Fourth Regiment of Infantry, Liberian Army, which Head Quarters being in Harper City, Maryland County, having reached the numerical strength of Regiments in keeping with our law relating to the militia, and which Detachments parade and are named and styled the Third and Fourth Battalions of said Regiment: and.

Whereas, it has also become evident that the Kakata Detachment of the Fifth Regiment in Montserado County has also reached the numerical strength of a Regiment in keeping with our laws relating to the militia of Liberia: and,

Whereas, for a more complete organization and for better control of the units composing the militia of the Republic of Liberia; Therefore,

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, the Kroo Coast Detachment, known as the Third Battalion of the Fourth Regiment in Maryland County, and the Detachment at Nyaake Webb, in District Number 1, of the Eastern Province, Liberian Hinterland, known as the Fourth Battalion of the above named Regiment, shall be created into two Regiments of Infantry and shall be known as the Eighth and Ninth Regiments respectively.

Section 2. That said Eighth Regiment of the Kroo Coast in Maryland County shall parade in the Township of Grand Cess and Garraway in accordance to the appointments of the Commanding Officer, and at the same time of the parades of the Fourth Regiment in Harper City.

Section 3. That the Ninth Regiment at Nyaake Webbo, shall parade in the Township of Nyaake Webbo also at the same time and hour as provided by Statute for the Fourth Regiment in Harper City.

Section 4. That the Kakata Detachment shall be created into a Regiment and shall be known as the Tenth Regiment of Infantry and shall parade at spots appointed by the Commanding Officer of the Regiment, in the District, and at the time and hour of the parades of the Fifth Regiment of Infantry in Montserrado County.

Section 1. That from and immediately after the passage of this Act, the Act of Legislature entitled: “An Act to amend an Act entitled: “An Act, amendmentary to the General Education Act of 1912″ Approved April 5, 1944” is hereby amended as follows:

That Section 1, paragraph 3 of the above Act, now being amended, be and the same is hereby amended to read:

The Secretary of Public Instruction prepare and enforce a general scheme of study for kindergarten, Primary, Intermediate, and Advanced Divisions of Public Schools; and the said scheme of study shall constitute the minimum standard requirement in the schools shall conform to such regulations as he shall issue in relation thereto. The curriculum of every school, operating within the Republic, shall conform to the courses through provided, and the text books prescribed by the Department of Public Instruction only shall be used in the Republic, provided that College or University shall have the privileges of selecting text books for the Collegiate or University courses; such selection shall be subject to approval of the Department of Public Instruction.

Section 2. That under the circumstances where any prescribed text books are out of print and cannot be obtained from the Publisher, the Secretary of Public Instruction shall be and is hereby vested with authority to provide suitable substitutes for the same without affecting the basic contents of the general scheme and or courses.1

Section 3. This Act shall take effect immediately and be published in hand- bills.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the

passage of this Act, the United Pentecostal Mission, Manoh, Gola Section, Montserrado County, Republic of Liberia, by and through Louie E. Harey, Field Superintendent of the Pentecostal Church of the United States of America operating in Liberia, he and the same is hereby granted six hundred (600) acres of public land allotted and situated as follows for the purpose of expanding its missionary, educational and industrial program:

(a) Manoh District Number one – Western Province – 500 Acres
(b) Baajah District Number one – Western Province – 100 Acres

Section 2. That the President of the Republic of Liberia be and he is hereby authorized to grant deeds for the aerages of public land mentioned in subsections (a) and (b) of this Act to the said United Pentecostal Mission, Manoh, Golah Section out of any public lands in the afore- mentioned District not otherwise encumbered.

Section 3. That Louie E. Harey, Field Superintendent of the United Pentecostal Church, United States of America operating in Liberia, and his successor in office shall hold and possess the aforesaid tracts of and as long as the said land is continuously used for the purpose herein set forth, provided that, should the said tract of land herein granted, cease to be employed for the purpose granted and specified said tracts of land together with all rights herein and privileges and appurtenances thereto belonging shall revert to the Government of the Republic of Liberia without compensation.

SMITH OF THE CITY OF EDINA, COUNTY OF GRAND BASSA, WHO RESIGNED AS SERGEANT AT- ARMS OF THE HOUSE OF REPRESENTATIVES OF THE REPUBLIC OF LIBERIA BECAUSE OF ILL- HEALTH, AN ANNUITY AND ALSO COLONEL W. S. BOYLES OF THE CITY OF MONROVIA, COUNTY OF MONTSERRADO, AN ANNUITY FOR DISTINGUISHED SERVICES RENDERED GOVERNMENT.

Whereas, Colonel J. E. Smith of the City of Edina, County of Grand Bassa, has served fourteen years as Sergeant at- Arms of the Honourable House of Representatives of the Republic of Liberia with every dignity, honesty and faithful zeal in the capacity as Sergeant at- Arms with credit to his country; and

Whereas, his health is now impaired and prevents him from being able to faithfully discharge and continue to perform the duties and functions attached to said position because of physical disability which when on active service occasion corporal injury to him in prosecution of the duties of said office; and

Whereas, Colonel W. S. Boyles of the city of Monrovia, County of Montserrado, has faithfully rendered active service in the many interior expeditions where it was necessary to hold out posts at the peril of his life against uprisings among the indigenous population from time to time during the establishment of peace and order in the Hinterland Districts as well as on the littoral parts of the Republic; and,

Whereas, no provisions were made in the General Annuities and Pension Act approved April 5, 1945, for persons permanently retired from further public service because of impaired health while in the service of Government;

Therefore,

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act Colonel J. E. Smith of the City of Edina, County of Grand Bassa, and Colonel W. S. Boyles of the City of Monrovia be and they are hereby granted each an Annuity in the sum of ($300.00) Three hundred dollars per annum for and during their natural life, in equal monthly installments of ($25.00) Twenty- five dollars per month.

Section 2. That the Secretary of the Treasury is hereby authorized and empowered under warrant of the President of Liberia to pay out of the Treasury from any money not otherwise appropriated, the same to them respectively, in the manner indicated in Section 1 hereof, it being understood that Colonel W. S. Boyles by reason of the provisions of this Act, shall be no longer entitled to benefits under the General Pension Act.

Whereas, it is the intention and policy of Government to give recognition to its deserved citizens

who have rendered efficient and satisfactory public services which are worthy of record and note, and

Whereas, the late Chief Justice C. L. Parson, father of Annie E. Davis, was among those of the first to preside over the Honourable the Supreme Court of the Republic of Liberia, and in which post he served with honor, credit and befitting dignity up to his death, thereby leaving one surviving heir, Mrs. Annie E. Davis now widow of the late Honourable Joseph H. Davis, who also rendered valuable and note- worthy services to Government, serving at one time as member of the Honourable the House of Representatives, Republic of Liberia, and

Whereas, the said Annie E. Davis, being now of the advanced age of 75 years, is rendered thereby informed and unable to work for herself to secure the necessary means of support being thus incapacitated by feeble health, Therefore

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, the said Annie F. Davis for the remaining period of her natural life be and is hereby granted annuity for the reasons in the preamble hereof, in the sum of one hundred and fifty dollars per annum, in regular monthly installments.

Whereas, during the firing of the said National Salute, an explosion occurred and seriously wounded his right eye and other parts of his body. causing him to be blind out of said eye, thereby incapacitating him from following his regular vocation to support and maintain himself and family; Therefore,

Whereas, the late Honourable J. W. S. Bowens, one time member of the Honourable House of Representatives, Republic of Liberia, did render Government valuable services worthy of note during his life time, he serving faithfully and efficiently in various positions covering a period of (twenty three (23) years, and A. E. Bowens, who worked side by side with him, most faithfully and devotedly, and since his death she has been endeavouring to live up to the standard and dignity befitting her late husband; and it now being that she is advanced in age, she is weak and feeble and being thus incapacitated, is unable to work for herself as formerly and thereby maintain herself in a manner suitable, Therefore

It is enacted by the Senate and House of Representa- tives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, the said, C. A. E. Bowens of the Settlement of Brewerville, Montserrado County, for the remaining period of her natural life, be and is hereby granted annuity in the sum of one Hundred and Fifty Dollars ($150.00) in regular monthly install- ments.

Whereas, the late Abraham Jackson of the County of Maryland, Republic of Liberia, having served the Republic of Liberia in several capacities faithfully, and

Whereas, the said Abraham Jackson deceased, leaving a widow who now resides in the Settlement of Barnesville, County of Montserrado, and Republic of Liberia, and who has been trying to maintain herself since the death of husband, and

Whereas, the said Amelia Jackson, of the Settlement of Barnesville, County of Montserrado, and Republic of Liberia, is declining in age and is unable to maintain herself, and

Whereas, it is befitting that public approbation should be shown such public servant; Therefore

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Annuity

Section 1. That immediately after the passage of this Act, Amelia Jackson of the Settlement of Barnesville, County of Montserrado, be and she is hereby granted an annuity in the sum of One Hundred and Forty- four Dollars ($144.00) yearly to be paid in regular monthly installments during her natural life.

Whereas, C. O. Tuning Sr. of the County of Sinoe has shown to the Legislature that he is due just compensation for public service rendered as Postmaster at Greenville during the years 1916-18; Therefore

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and after the passage of this Act, C. O. Tuning, Sr. of the County of Sinoe be and is hereby granted compensation in the sum of Two Hundred and Forty Dollars ($240.00) for public services rendered as Postmaster at Greenville during the years 1916-18.

AN ACT CREATING NYAAKE, WEBBO NO. 1 DISTRICT, EASTERN PROVINCE, REPUBLIC OF LIBERIA, A TOWNSHIP

Whereas, the citizens inhabiting the area known as Nyake, Webo number 1 District, Eastern Province, Republic of Liberia, have petitioned and intimated to the National Legislature their desire to be organized into and established a civilized Community within their tribal Territory; and

Whereas, it is the policy of the Government to foster and encourage the organization and establish ment of civilized Communities and granting to the inhabitants a recognized form of Local Government;

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, Nyake, Webo number one District, Eastern Province, Republic of Liberia, he and the same is hereby incorporated and declared a body politic and corporate under the name and style of the Township of Nyake, Webo, Eastern Province, Republic of Liberia, and by this name may sue and be sued, plead and be implead in any courts of this Republic having competent jurisdiction, and to enjoy all and singular the rights and privileges enjoyed by similar bodies corporate and politic.

Section 2. That the boundaries of the Township of Nyake shall be all that portion or parcel of land in the Webo area, Eastern Province described as follows:

Commencing from the southern bank of the mouth of the Niplu Creek where it enters into the Cavalla River; running from thence in a line due West six (6) miles to a point; thence in a line due South six (6) miles to the Cavalla River; and thence in

a line parallel with the Cavalla River to the mouth of the Niplu Creek or the place of beginning. All to contain no more than Eight (8) Square miles.

Section 3. Nothing in this Act shall be construed to subordinate the tribal Authority of Webbo, Number one District, Eastern Province, to the said Township Authority, nor shall the tribal Authority in any way be permitted to interfere with the Local Administration of the Township Authority.

Section 1. That from and immediately after the passage of this Act, the Religious Society of which

today Armah Krawour is Amari Muminina or Priest, and President, Dawoda Krawom is assistant Amari Muminina or Vice President, Saugba Kiawom is Kartibo or Secretary, Karmoh Kamarah, Mono Kamarah, Mono Gasper, Braimah Passawe, Verini Dawoda, today Braimah, Momolu Massaquoi Sorbei, Mono Zeka, Boima Ko Mokai, Sraffo Spaaca, and Mambu Fahnbuleh, Board of Managers together with all other who may associate themselves with them, be and the same is hereby incorporated and declared a body politic and incorporate under the name and style of the Jadaka Saadatu, Dieni Tarigi Lmu Ha Madiati, and by this name may sue and be sued, plead and be implead in any of the courts of the Republic of Liberia having competent jurisdiction.

Section 2. The Jadaka Saadatu Dieni Tarigi Lmu Ha Madiati is an Islamic Religious and Philanthropic Society with a present membership of 1592 persons whose object is to promote a deeper study of the Koran and other Islamic Writings and religious practices and observances; to aid and assist its members in cases of sickness, death or other distress, to give aid and relief to the poor and destitute, travellers and strangers in need and to promote a better understanding among all men especially among the faithful.

Section 3. The Jadaka Saadatu Dieni Tarigi Lmu Ha Madiati shall have the right to acquire and possess real and personal property to the value of thirty thousand ($30,000) dollars, to make a constitution and bye- laws for its governance provided that such constitution and bye- laws shall not conflict with the Constitution and Statute Laws of the Republic and to enjoy all singular the rights and privileges enjoyed by similar bodies politic and corporate.

AN ACT REIMBURSING THE HEIRS OF THE LATE ALLEN N. YANCY OF MARYLAND COUNTY, REPUBLIC OF LIBERIA.

Whereas, the legal heirs of the late Allen N. Yancy have petitioned the Legislature to be reimbursed for the private amount their late father expended on the construction of a public bridge across the Hoffman River, and

Whereas, it is the policy of the Government to settle all legitimate claims made against her; Therefore,

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, the legal heirs of the late Allen N. Yancy of Maryland County be and they are hereby reimbursed in the sum of one thousand ninety- seven dollars and fifty- two cents ($1,097.52) as full settlement of the amount expended on the construction of the public bridge across Hoffman River, Maryland County.

Whereas, during the years 1931 and 1932 together with 6 months of 1930, Samuel W. Payne served as a Clerk to the County Attorney for Grand Bassa County at a quarterly pay amounting to two hundred dollars per annum which he did not receive due to the depression at the time existing; and

Whereas, the amount was not carried as arrears as it should have been, due to no fault of his own but through error duly set out and made to appear to the satisfaction of the Legislature; Therefore,

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act Samuel W. Payne, of Grand

Bassa County be paid the sum of five hundred dollars (S500.00) for services rendered the Republic of Liberia in the capacity above set out in the preamble of this Act.

Section 1. That from and immediately after the passage of this Act. the estate of the late A. J. E. Sawyer of Monrovia, Montserrado County, be and is hereby granted remuneration in the sum of one thousand one hundred and fifty dollars ($1,150.00) for services rendered the Government in the capacity of Comptroller of the Treasury, Republic of Liberia.

Section 2. That the Secretary of the Treasury is hereby authorized under Warrant of the President to pay said sum out of any money in the Public Treasury not otherwise appropriated.

AN ACT TO REPEAL SECTION 918 OF THE REVISED STATUTE AND ALLOWING VESSELS, OWNED BY FOREIGNERS TO BE REGISTERED AND TO OPERATE WITHIN THE TERRITORIAL WATERS OF LIBERIA, FLYING THE LIBERIAN PLAG.

Whereas, the Statutory provisions of the Laws of the Republic of Liberia prohibit vessels owned by any foreigner to be registered and to operate within the territorial waters of Liberia, and

Whereas, such Statutory law or parts of law tend

to impede the progress and development of transportation, trade, and commerce of the Republic of Liberia;

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, that portion of the Statutory law, the Revised Statute Volume 1, page 776 Section 918, prohibiting vessels owned by any foreigner or by citizen usually residing in any foreign country, to be registered and to operate in Liberian Waters is hereby repealed.

Section 2. That the Act of the President of the Republic of Liberia in suspending that portion of the Statutory law of the Republic of Liberia, Revised Statute Volume 1, page 776 Section 918, and allowing vessels to be registered owned by a foreigner to operate within the Territorial Waters of Liberia and flying the Liberian Flag, such Act of the President is hereby approved.

Section 3. This Act shall take effect immediately and be published in hand- bills.

AN ACT GRANTING THE LIBERIA ANNUAL CONFERENCE OF THE METHODIST CHURCH LIBERIA TWO HUNDRED (200) ACRES OF LAND WITHIN THE GBARNGA DISTRICT, CENTRAL PROVINCE, LIBERIAN HINTERLAND FOR AGRI- CULTURAL AND TRADE SCHOOL PURPOSES.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the

passage of this Act, the Liberia Annual Conference of the Methodist Church by and through Bishop Willis J. King of the Methodist Church of Liberia and Charles E. Cooper, Treasurer of the Liberia Annual Conference, he and the same is hereby granted two hundred (200) acres of public land within the Gbarnga District, Central Province, Liberian Hinterland for agricultural and trade school purposes.

Section 2. That the President of the Republic of Liberia he and he is hereby authorized to grant a deed for the two hundred (200) acres of public land herein granted, out of any public lands in the aforementioned District not otherwise encumbered.

Section 3. That the Liberia Annual Conference of the Methodist Church of Liberia shall hold and possess the aforesaid tract of land as long as the said land is continually used for the purpose herein set forth, providing that the grantee commence operation within two (2) years from the date of the approval of this Act and that should said grant cease for three (3) consecutive years to be enjoyed and used for the purposes herein specified, said land together with all rights thereon and all buildings and appurtenances thereto belonging shall revert to the Government of the Republic of Liberia without compensation.

Section 2. That the said Institute or body corporate may sue ani be sued, plead and be implead in any of the Courts of the Iepublic having com petent jurisdiction, may hold and own real and personal property to the value of Twenty thousand dollars

Section 1. That from and immediately after the passage of this Act, the Nyforquellie Gospel Mission of the Nyforquellie Chiefdom, by and through Rev. Moses Nathaniel Washington, of the Pentacostal Faith,

be and the same is hereby granted one hundred (100) acres of land within the Nyforquellie Chiefdom, District No. 4, Central Province, Liberian Hinterland, Liberia, for religious, educational and industrial purposes.

Section 2. That the President of the Republic of Liberia be and he is hereby authorized to grant a deed for the one hundred (100) acres of public land herein granted, out of any public lands in the aforementioned Chiefdom not otherwise encumbered.

Section 3. That the said Nyforquellie Gospel Mission shall hold and possess the aforesaid tract of land as long as the said land is continually used for the purposes herein set forth, provided however, that the grantee commence operation within two years from the date of the approval of this Act and that, should said grant cease for three (3) years consecutively to be employed and used for the purposes herein specified, said land together with all the rights thereon and all buildings and appurtenances thereto shall revert to the Government of the Republic of Liberia without compensation.

Section 1. That from and immediately after the passage of this Act, Frances Davis- Blatch, Principal and Founder, and Elizabeth Jones, Robertetta A. Howard, L. M. J. Dyson, Mary Janes Cranshaw,

Dianah L. Jones and Clara L. Acolatze, Executive Committee, together with others and their successors in office, are hereby declared and constituted a body politic and incorporate under the name and style of the Light- House Full Gospel Mission Pentecostal of Monrovia, Montserrado County, Republic of Liberia, with the right to hold, possess and enjoy real and personal property to the value of Twenty thousand dollars (20,000.00) that may be acquired by purchase, bequeath, gift, endowments or otherwise.

Section 2. That the Institute or body corporate shall have the right to sue and be sued, plead and be implead before any of the Courts of this Republic having competent jurisdiction and shall have the right to do all other things done by similar bodies corporate.

Section 3. That the said Institute or body corporate is hereby vested with full power and authority to make and establish such by- laws and regulations for their government and the government of the employees maintained by them, and to do all other acts and things done by similar bodies corporate that are not repugnant to the Constitution and Laws of the Republic of Liberia.

Section 1. That from and immediately after the passage of this Act, John Henry Wright, Superintendent, and the President, Officers and Members of the

Executive Board of the Lott Carey Mission Schools, Montserrado County, Republic of Liberia, together with their successors in office, be and they are hereby declared a body politic and incorporate under the name and style of the Lott Carey Mission Schools, Montserrado County, Republic of Liberia, with the right to hold, possess and enjoy real and personal property to the value of Fifty thousand dollars (50,000.00) that may be acquired by purchase, bequeath, gift, endowments or otherwise.

Section 2. The said body corporate shall have the right to sue and be sued, plead and be implead before any of the Courts of this Republic having competent jurisdiction; shall have the right to do all other things done by similar bodies corporate.

Section 3. The said body corporate is hereby vested with full power and authority to make and establish such by- laws and regulations for their government and the government of the employees maintained by them, and to do all other acts and things done by similar bodies corporate that are not repugnant to the Constitution and Laws of the Republic of Liberia.

AN ACT GRANTING TIAR- KLAR, A RETIRED PARAMOUNT CHIEF OF THE NYEOMWEAH TRIBE, MARYLAND COUNTY AN ANNUITY.

Whereas, Tiar- Klar, a citizen of the County of Maryland, was for the period of thirty years, a loyal citizen of the Republic, did during all the years of his incumbency as a Paramount Chief serve with notable efficiency and loyalty to the Government of the

Republic and his people in the capacity of Paramount Chief of the Nyeomweah Tribe, Maryland County, Republic of Liberia; and

Whereas, because of the old ripe age to which he has now attained while in service with attending physical infirmities and broken health, all of which have united in disabling him in the discharge of the duties of said office, whereupon he was, during the year 1946, honorably retired to private life and is without means to support and maintain himself and family; and

Whereas, said public position in which he has so ably served, up to the time of his said honorable retirement, does not fail within provisions of the general Annuities and Pensions Act of the Legislature passed and approved April 5, 1944; and it being the policy of our Government to manifest appropriate recognition for, and to extend consideration to such retired public servants of her citizenry; Therefore,

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That immediately from and after the passage of this Act, Tiar- Klar, retired paramount chief of the Nyeomweah Tribe, Maryland County, Republic of Liberia, be and he is hereby granted an annual pension in the sum of One hundred and forty- four dollars ($144.00) for the duration of his natural life and the Secretary of the Treasury be and he is hereby authorized, under Warrant of the President, to pay same out of any moneys in the Public Treasury not otherwise appropriated, in equal monthly instalments of Twelve dollars ($12.00) each.

When effective

Section 2. This Act shall take effect as from the first day of January A. D. 1947.

CHAPTER LXII
AN ACT GRANTING N. GEORGIA PAYNE OF THE CITY OF BUCHANAN, GRAND BASSA COUNTY, A PENSION.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, N. Georgia Payne, of the City of Buchanan, County of Grand Bassa, be and she is hereby granted an annual pension of One hundred and forty- four dollars ($144.00) for and during her natural life.

Section 2. That the Secretary of the Treasury is hereby authorized to pay same, under Warrant of the President of the Republic of Liberia, in monthly instalments of Twelve dollars ($12.00) from any money in the Public Treasury not otherwise appropriated. Any law to the contrary notwithstanding.

AN ACT APPROVING THE CONSTITUTION OF THE UNITED NATIONS EDUCATIONAL, SCIENTIFIC AND CULTURAL ORGANIZATION DONE IN LONDON 19TH NOVEMBER 1945.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act the Constitution of the United Nations Educational, Scientific and Cultural Organization, done in London, 16th November 1945, be and the same is hereby approved.

AN ACT GRANTING THE PROTESTANT EPISCOP- AL CHURCH OF THE UNITED STATES OF AMERICA, OPERATING WITHIN THE REPUBLIC OF LIBEBIA, BY AND THROUGH BRAVID W. HARRIS, BISHOP OF LIBERIA, AND HIS SUCCESSORS IN OFFICE ONE HUNDRED AND FORTY- TWO (142) ACRES OF LAND FOR MISSIONARY, EDUCATIONAL AND INDUSTRIAL PURPOSES.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, the Protestant Episcopal Church of the United States of America, operating within the Republic of Liberia, by and through Bravid W. Harris, Bishop of Liberia and his successors in office be and same hereby granted One hundred and forty- two (142) Acres of land allotted and situated as follows for Missionary, Educational and Industrial purposes: (a) Bolahun, Western Province, Liberian Hinterland, One hundred and seventeen (117) Acres.

(b) Valassa Western Province, Liberian Hinterland, twenty- five (25) Acres.

Section 2. That the President be and he is hereby authorized to grant deeds for the acreage of Public land mentioned in Sub- sections (a) and (b) of Section “1” of this Act, to the said Protestant Episcopal Church out of any Public lands in the areas of Bolahun and Valassa, Western Province, Liberian Hinterland,

already occupied by the Holy Cross Mission, an established Order of the Protestant Episcopal Church.

Section 3. That Bravid W. Harris, Bishop of Liberia, for and on behalf of the Protestant Episcopal Church, and his successors in office shall hold and possess the aforesaid tract of land as long as the said land is continually used for the purpose herein set forth. And that should said grant cease for three consecutive years to be employed and for purposes herein specified, said lands together with all rights thereon and all buildings and appurtenances thereto belonging shall revert to the Government of the Republic of Liberia without compensation.

AN ACT GRANTING SUSAN SHARPE OF MON- ROVIA, MONTSERRADO COUNTY, R. L. AN ANNUITY.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and after the passage of this Act, Susan Sharpe of Monrovia, Montserrado County, for efficient, honest and loyal services rendered the Republic of Liberia as Stamp Agent for the Monrovia Post Office for a number of years, be and is hereby granted an Annuity of Four hundred and fifty dollars ($450.00) during her natural life.

Section 2. That the Secretary of the Treasury is hereby authorized to pay this amount in equal monthly installments under Warrant of the President out of any money in the Public Treasury not otherwise appropriated.

Section 3. That the effective date of this Act shall be the first day of January, A. D. 1947.

CHAPTER LXVI
AN ACT TO AUTHORIZE THE LIBERIAN CON- STRUCTION COMPANY TO IMPORT TOOLS AND OTHER EQUIPMENT FOR ROAD CONSTRUCTION FREE OF DUTY.

Preamble

Whereas, a contract to complete the Salala- Baila Road has been made with the Liberian Construction Company, and,

Whereas, the said Liberian Construction Company has asked permission to import tools and other equipment for the construction of this stretch of road free of duty, and

Whereas, in order to facilitate and expedite the work of this road the Government of Liberia deems it expedient to grant the Company’s request.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, all tools and other equipment imported directly or indirectly by the Liberian Construction Company for the construction of the Salala- Baila Road, and for the purpose of putting a bridge across the St. John River shall be free of duty.

Section 2. This Act shall take effect immediately and be published in hand- bills.

Any law to the contrary notwithstanding.

CHAPTER LXVI

AN ACT GRANTING THE “LIBERIAN INDEPENDENT, GOOD WILL, INDUSTRIAL AND RELIGIOUS SCHOOL” TWO HUNDRED ACRES OF LAND WITHIN THE GIBI CHIEFDOM, CENTRAL PROVINCE, LIBERIAN HINTERLAND, LIBERIA.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the

passage of this Act, the “Liberian Independent, Good Will, Industrial and Religious School” of the Gibi Chiefdom, Central Province, Liberian Hinterland Liberia, by and through Rev. Miss Alemena J. Smith, Principal thereof, be and the same is hereby granted Two hundred (200) acres of public land, within the Gibi Chiefdom, Central Province, Liberian Hinterland, Liberia, for religious, educational and Industrial purposes.

Section 2. That the President of the Republic of Liberia be and he is hereby authorized to grant a deed for the two hundred (200) acres of public land herein granted, out of any public lands in the aforementioned chiefdom not otherwise encumbered.

Section 3. That the said “Liberian Independent Good Will, Industrial and Religious School” shall hold and possess the aforesaid tract of land as long as the said land is continually used for the purposes herein set forth, provided however, that the grantee commences operation within two years from the date of the approval of this Act, and that, should said land cease for three (3) years herein specified, said land together with all of the rights thereon and all buildings and appurtenances thereto belonging shall revert to the Government of the Republic of Liberia without compensation.

AN ACT GRANTING ANNUITY TO SENATOR A. B. MARS OF THE COUNTY OF MONTSERRADO, REPUBLIC OF LIBERIA.

Whereas, Senator A. B. Mars of the County of Montserrado, Republic of Liberia, has for more than forty years served in the House of Representatives and Senate as Representative and Senator, by election of his constituency for a period of more than forty

years, and during this period has shown marked and outstanding ability and evidenced the true spirit of patriotism, and

Whereas, the period of his services in the National Legislature is unprecedented in the Legislative History of the Country; Therefore:

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and after the first day of May A.D. 1947, Honourable A.B. Mars shall receive during the residue of his natural life, an annual Annuity of Eight hundred dollars ($800.00) to be paid to him in equal monthly installments out of any money in the Public Treasury, not otherwise appropriated.

Section 2. The Secretary of the Treasury is hereby authorized and empowered to draw and make payments to Honourable A.B. Mars the sum above stated upon Warrant of the President.

Section 3. This Act shall take effect immediately and be published in hand- bills.

AN ACT INCORPORATING THE “ABOSO APOSTOLIC FAITH CHURCH OF JESUS CHRIST OF LIBERIA”, MONTSERRADO COUNTY, REPUBLIC OF LIBERIA.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the passage of this Act, Rev. R. W. Herrick, Elder and Superintendent; William Bortty, Chairman, Board

of Trustees; Charles T. O. King, Vice Chairman, Board of Trustees; Juah Wiseh, Deacon; Boe Sanso, Secretary; S. T. Roberts; Isaac S. Twe, Chieh Same- way, together with others and their successors in office, are hereby declared and constituted a body politic and corporate under the name and style of the “Aboso Apostolic Faith Church of Jesus Christ of Liberia,” Montserrado County, Republic of Liberia, with the rights to hold and possess as well as enjoy real and personal property to the value of Eight thousand dollars ($8000.00) that may be acquired by purchase, bequeath, gift, endowment or otherwise.

Section 2. That the body corporate shall have the right to sue and be sued, plead and be implead- ed before any of the Courts of this Republic having competent jurisdiction, and shall have the right to do all other things done by similar bodies corporate.

Section 3. That the said body corporate is hereby vested with full power and authority to make and establish such bye- laws and regulations for their government and the government of the employees maintained by them, and to do all things and acts done by similar bodies corporate that are not repugnant to the Constitution and Laws of the Republic of Liberia.

AN ACT GRANTING THE ASSEMBLIES OF GOD MISSION IN LIBERIA ONE THOUSAND SEVEN HUNDRED ACRES OF LAND IN THE EASTERN PROVINCE AS INDICATED IN THE BODY OF THIS ACT FOR EXPANSION OF RELIGIOUS AND EDUCATIONAL PROGRAMS.

It is enacted by the Senate and House of Representatives of the Republic of Liberia in Legislature assembled:

Section 1. That from and immediately after the

passage of this Act, the Assemblies of God Mission, by and through Ebon L. Mason, Supervisor of the Assemblies of God Mission in Liberia, be and the same is hereby granted One thousand and seven hundred (1,700) acres of land from public Domain in the several sections and Province hereunder stated for expansion of religious and educational purposes.

Section 2. That the President of the Republic of Liberia be and he is hereby authorized to grant deeds for the several plots herein granted, out of any public land in the aforementioned Province in the following manner:

Eastern Province: Tshien section 300 acres Putu 300 Konobo 200 Feloka 300 Bawah 300 Newoka 300

Section 3. That the Assemblies of God Mission in Liberia shall hold and possess the aforesaid plots of land to them granted as the said land is continually used for purpose herein set forth, providing that the grantee commence operation within three years from date of the approval of this Act; and that should said grant cease for four (4) consecutive years to be employed and used for the purposes herein specified, and said land together with all rights thereon and all buildings and appurtenances thereto belonging shall revert to the Government of the Republic of Liberia without compensation.

Section 1. That from and immediately after the passage of this Act, Elijah A. L. McCaulley of Sinoe County, Republic of Liberia, be and he is hereby restored to all the rights and privileges of citizenship in common with all other good citizens of the Republic.
