JUDGMENT WITHOUT OPNION

When this case was called for hearing, Counsellor Powo C. Hilton and Janniedel Haider Tandjiekpon, of the Alliance Consulting Group, Inc. appeared for .the movant. Counsellor Molley N. Gray, Jr. of the Jones and Jones Law Firm appeared for the respondent.

The lawyer representing the respondent, Counsellor Molley N. Gray, .Jr. by leave of Court and in response to the he respondent’s appeal, made a submission on the minutes al and factual averments contained in the motion to dismiss, follows:

“At this stage, counsel for the—roponde agement -of AutoSpare Service informs this Co ppeal in this matter, he filed.his bill og•exeeptions itllin ta f -bu ailed to secure an appeal bond and the service and •filing of a n tic of completion of appeal. Counsel therefore concedes to the motion to dismiss in its entirety. And respectfully submits.”

It is the law that “all admissions made by a party himself or by his agent acting within .the scope of his authority are admissible.” Civil Procedure Law Rev. Code 1:28.8(1).

Hence, this Court being satisfied that the concession by the respondent’s counsel is in keeping with law, it is hereby

ADJUDGED:

That the motion to dismiss the appeal is hereby granted, and the appeal ordered dismissed as a matter of law. The Clerk of this Court is ordered to send a mandate to the
