JUDGMENT WITHOUT OPINION

When this case was called for hearing, Counsellors Idris S. Sheriff and Dexter C. Tiah of Henries Law Firm appeared for the movant/appellee. Counsellors Amara M. Sheriff of the J. Johnny Momoh and Associates Legal Chambers and Jonathan Massaquoi of the International Law Group (ILG) appeared for the responderWappeilant.

One of counsels for the respondent/appellant, Counsellor Amara M. Sheriff, by leave of Court, made a submission on the minutes of Court, informing this Court that he concedes the legal soundness of the motion to dismiss the appeal filed by the movant/appellee. The Counsel spread on the minutes of Court as follows:

“At this stage, one of counsels for the respondent says that they, as succeeding counsels of records, have perused the case file and realized that certain jurisdictional steps required to be taken by the respondent/appellant were never-taken.and therefore concedes the legal soundness of the movant’s motion to dismiss the respondent’s/appellant’s appeal. And most respectfully submits.

To this submission, the counsels for the movant/appellee interposed no objection.

This Court, having carefully considered the submission made by one of counsels for respondent/appellant and ascertained from the said counsel as to whether his client had full knowledge of and acquiesced to the submission made, and the counsel having answered in the affirmative; and having perused the motion and being satisfied that it is in conformity with the laws controlling, it is hereby:

ADJUDGED:

That the motion filed by the movant/appelle€tödjSTiiiss the appeal is hereby granted. The Clerk of this

Court is ordered to send a mandatetto the Judge presiding Lin the Court below to resume jurisdiction over this case and give effect to this judgment. Costs are ruled against the respondent/appellant. It is hereby so
