JUDGMENT WITHOUT OPINION

Decided: July 29, 1981.

When this case was called for hearing Counsellor Logan Broderick appeared for appellant and Solicitor General Jimmie S. Geizue appeared for appellee and gave notice of abandonment of further prosecution of the case. In view of the notice of abandonment as spread upon the records, it is adjudged that the notice of abandonment given by the Solicitor General is hereby granted and the case ordered stricken from the docket and the appellant ordered discharged without day and his criminal appearance bond delivered to him.

The Clerk of this Court is ordered to send a mandate down to the trial court commanding the judge presiding therein to resume jurisdiction over the case and have the appellant discharged from further answering to this charge. And it is hereby so ordered.

NOTE: His Honour Boima K. Morris having presided over this case as Circuit Judge in the court below recused himself from the hearing and determination of this case; hence he did not sign this judgment.

His Honour Roosevelt S. T. Bortue, being counsel for one of the parties previous to his elevation to the Bench, recused himself from the hearing and consideration of said case; hence he has not signed this judgment.
