When this case was called for hearing, no one appeared for appellant. Solicitor General Jimmie S. Geizue appeared for the appellee and gave notice of abandonment for further prosecution of this case. It is adjudged that in view of the notice of abandonment given by the Solicitor General as spread upon the records of this Court, the said notice is hereby granted and the case ordered stricken from the docket. And the appellant is ordered discharged without day. The Clerk of this Court is hereby ordered to send a mandate to the trial court to this effect. And it is hereby so ordered.
