INTERLOCUTORY ORDER

 

During the reading of the records in each of the two causes above entitled, both on appeal from the Circuit Court of the First Judicial Circuit, Montserrado County, it was discovered that the clerk of said court had transmitted to this Court sundry originals of documentary evidence admitted during the trial.

 

In the case Hulsmann v. Johnson and Johnson, an action of debt decided by this Court on the 10th day of February[1909] LRSC 3; , 1909, 2 L.L.R. 20, I Lib. Ann. Ser. 23, this Court decided that the Supreme Court “takes cognizance of matters of this nature only upon the face of certified copies of the proceedings in the lower court transmitted through the proper channel.” This opinion was confirmed by this Court in the case Bey-Solow v. Gordon, an action of damages, decided by this Court on January 29th[1913] LRSC 4; , 1913, 2 L.L.R. 95, I Lib. Semi-Ann. Ser. 12.

 

In view of the aforesaid this Court suspended the further reading of the record in each of the said cases, and now issues this interlocutory order :

 

1) That the Clerk of this Court will issue a Mandate directed to the Judge of the Circuit Court of the First Judicial Circuit, commanding him to order the clerk of said court to forthwith withdraw the said original documents, and file in lieu certified copies of the said Mandate. Given under our hands and the seal of this Court this 14th day of May A. D. 1937.
