Barnard ap- Assignment for the hearing of this case was issued, served and returned for hearing on June 5, 1975, but when the case was called, no one appeared for the appellant. Counsellor Toye C. Barnard appeared for the appellee and moved the Court to apply Rule IV, Part 6, of the Revised Rules of the Court, with respect to failure of counsel to appear or file a brief. After studying the appellee’s brief and the record of the case, it is adjudged that the judgment of the trial court should be and the same is hereby affirmed with costs against the appellant. And the Clerk of this Court is ordered to send a mandate to the court below commanding the judge therein to resume jurisdiction and enforce the judgment. And it is so ordered.
