JUDGMENT WITHOUT OPINION. Decided May 2, 1975. Nathan Ross for appellant. Samuel E. H. Pelham for appellee. At the call of this case, Counsellor Nathan Ross appeared for the appellant. Counsellor Samuel E. H. Pelham appeared for the appellee and filed a motion to dismiss the appeal on the ground that the appellant had failed and neglected to take two of the steps necessary to the completion of an appeal; namely, to file within sixty days an appeal bond, and to have a notice of completion of appeal issued and served on the appellee as the law requires. After studying the motion, and there being no resistance thereto, it is adjudged that the motion should be and the same is hereby granted and the appeal is dismissed with costs against the appellant. The Clerk of this Court is ordered to send a mandate to the court below commanding the judge therein to resume jurisdiction and enforce the judgment. And it is so ordered. 371
