JARBEE FOFANAH, Appellant v. JAMES K. SOWAH, Appellee.

JUDGMENT WITHOUT OPINION. Decided December 31, 1975. No appearance by either party. When this case was reached on the motion calendar it was observed that the appellee had filed a motion on December 1 i, 1972, conceding the correctness of the appellant’s attack upon the trial court’s jurisdiction over the subject matter and, therefore, praying that the Supreme Court vacate the proceedings. No one appeared for either party at the call of the case; therefore, in keeping with Rule III, Part 3, of the Supreme Court Rules, it is adjudged that the appeal before the Supreme Court should be and the same is hereby dismissed without costs to either side. And the Clerk of this Court is ordered to send a mandate to the trial court, commanding the judge presiding therein to resume jurisdiction and strike the case from the docket of the Debt Court, thereby restoring the parties to status quo ante. And it is so ordered. 561
