JUDGMENT WITHOUT OPINION. Decided February 1, 1973.* No appearance for appellant. Barnes for appellee. Solicitor General When this case was called no one appeared for the appellant. Solicitor General Roland Barnes appeared for the appellee and made request that in view of the absence of the appellant after having been notified to appear, Rule IV, Part 6, of the Supreme Court Rules be applied. In addition to appellee’s request for enforcement of the Rule the Marshal informed the Court that when the notice of assignment was served appellant indicated that he did not intend to defend the appeal. In view of appellee’s request, and also in view of the Marshal’s report, it is hereby adjudged that the judgment of the trial court should be and the same is hereby affirmed. The Clerk of this Court is ordered to send a mandate to the trial court commanding it to resume jurisdiction and enforce its judgment. * The Chief Justice and Justice Henries disqualified themselves herein for participation in the case prior to appointment to the Court. 531
