Dossen Richards, one of counsel for the appellee, noted for the record that he joined the appellant in requesting the Court to reverse the judgment and remand the case to be tried anew, because he could not defend the ground upon which the trial judge had decided the case in the court below. After due consideration, it is adjudged that the judgment in this case should be and the same is hereby reversed and the case remanded to the trial court, with instructions that the judge next assigned pass upon the issues of law and hear and determine the case. Costs to abide final determination. And it is so ordered. 254
