MESSRS. DEMOBKA AND MALIKABBARI, Appellants, v. ASHOKA, Appellee.

JUDGMENT WITHOUT OPINION. Decided June 12, 1970.* No appearance for parties. At the call of this case for hearing, no one appeared for the parties. After due consideration, it is hereby adjudged that this case having been regularly docketed, assigned, and bulletined for hearing, and neither of the parties having appeared in person or by counsel, and no request having been made to this Court for the continuance of said case, appellant’s motion for diminution of records is hereby denied and ordered stricken from the docket with costs against appellants ; and counsellor James H. Smythe, of counsel for the appellants, is hereby fined in the sum of $5o.00 for failing to appear at the call of the case for hearing. Upon his failure to comply with the ruling of this Court, he shall be suspended from the practice of law until said ruling shall have been complied with by the payment of said fine. And it is hereby so ordered. * Mr. Justice Mitchell did not sit in the case. 145
