FRANCIS H. GIBSON, Appellant, v. REPUBLIC OF LIBERIA, Appellee.

JUDGMENT WITHOUT OPINION ON APPEAL IN ACTION FOR FORECLOSURE OF INDEMNITY BOND. Decided January 14, 1960. No appearance for appellant. Assistant Attorney General J. Dossen Richards for appellee. When this cause was called for hearing, no one appeared for the appellant. Assistant Attorney General J. Dossen Richards appeared for the appellee and gave notice of the filing of a motion to strike. After considering the motion as filed and the records certified to this Court, it is hereby ADJUDGED that, two terms of this Court having elapsed since the taking of this appeal, and there not having appeared any representative of the deceased party with a petition for substitution in keeping with the rules of Court, and the appellee having filed a motion to strike the said case from the docket of this Court, the said motion is hereby granted and the case ordered stricken from the docket of this Court, and the decree of the lower court ordered enforced. And the clerk of this Court is hereby ordered to send a mandate to the court below informing it of this judgment.
