JUDGMENT WITHOUT OPINION. Decided November 19, 1976.* When this case was called for hearing, Counsellor Wade Appelton appeared for appellant and Counsellor Edward Woller appeared for appellees and filed a motion to dismiss the appeal on the ground of noncompliance with the statutory provisions regulating appeals. Rev. Code 1:51.8. After studying the motion, and the appellant’s counsel having conceded the correctness thereof, it is adjudged that the motion should and the same is hereby granted and the appeal dismissed with costs against the appellant. The Clerk of this Court is ordered to send a mandate to the court below commanding the judge therein to resume jurisdiction over the cause and enforce the judgment. It is so ordered. Hr.
