When this case was called, Counsellor Jacob Willis appeared for the plaintiff in error. Counsellor J. Dossen Richards appeared for the defendants in error and filed a motion to dismiss the appeal on the grounds : (1) that counsel for the plaintiff in error was not licensed for the year 1975 at the time of the filing of his petition, as was certified by the Ministry of Finance, and (z) that the petition and accompanying affidavit of the plaintiff in error was not stamped, in accord with statutory requirements. Counsel for plaintiff in error in resisting the motion argued that in view of the certificate from the Finance Ministry, he did have a license and that the Justice in chambers was in error not to have given him twenty-four hours to stamp his documents filed in the Clerk’s office. Counsel could not cite any rule to support this position of being entitled to twenty-four hours to stamp documents already filed in the office of the Clerk of Court. In view of the circumstance it is adjudged that the ruling of the Justice in chambers dismissing the petition is hereby affirmed, with costs against the plaintiff in error. The Clerk of this Court is ordered to send a mandate to Mr. Justice Wordsworth, who presided over these proceedings in chambers, did not participate in this decision. 571
