MOTION TO DISMISS APPEAL

JUDGMENT

When this case was called for hearing, Counsellor Emmanuel B. James of the International Group of Legal Consultants and Advocates appeared for the movant/appellee and Counsellor James N. Kumeh appeared for the respondent/appellant.

Having heard the legal arguments and contentions advanced by the parties, reviewed the facts and circumstances presented and revealed by the records, and examined and studied the laws cited and relied upon by the parties and controlling, and being satisfied that upon the said examination and review, and convinced that the motion to dismiss has legal basis, it is hereby

ADJUDGED

That the Motion to Dismiss be and the same is hereby granted. The appellant not having filed an appeal bond and served and filed a notice of completion of the appeal, the same being mandatory requirements of Chapter 51 of the Civil Procedure Law for the perfection of an appeal and conferral of jurisdiction on the Supreme Court to hear the said appeal, the appeal is hereby denied.

The Clerk of this Court is hereby ordered to send a mandate to the Civil Law Court, Sixth Judicial Circuit, Montserrado County, commanding the judge presiding therein to resume jurisdiction over this case, and to proceed to enforce the judgment of this Court, consistent with law. Costs are adjudged against the defendant/appellee.

GIVEN UNDER OUR HANDS AND SEAL OF THE HONOURABLE SUPREME COURT OF THE REPUBLIC OF LIBERIA THIS 15TH DAY OF JULY A. D. 2013.

Madam Justice Yuoh not having ascended to the position of Associate Justice of the Supreme Court at the hearing of this case, and therefore not having participated in the hearing of this case, she did not sign this judgment.
