JUDGMENT WITHOUT OPINION
Decided: December 20, 1979.
When this case was called, Counsellor Peter Amos George appeared for the appellant, and Counsellor Clarence E. Harmon appeared for the appellee and filed a motion to dismiss the appeal on the ground that none of the jurisdictional steps neces-sary to the taking and completing of an appeal was taken to have given this Court jurisdiction over this appealed case. After considering the motion, and the appellant’s counsel having conceded the soundness thereof, it is adjudged that the motion to dismiss should be and the same is hereby granted and the appeal is dismissed with costs against the appellant.
The Clerk of this Court is ordered to send a mandate down to the lower court commanding the judge presiding therein to resume jurisdiction over the cause and enforce the judgment. And it is so ordered.
