JUDGMENT WITHOUT OPINION

When this case was called, Counsellor J. Dossen Richards appeared for appellant, and Counsellor Francis N. Topor appeared for the appellee and filed motion to dismiss the appeal for failure of the appellant to proceed. After studying the motion and the resistance filed thereto, and after hearing arguments on both sides, it is adjudged that the grounds laid in the motion to dismiss the appeal are not tenable in view of a postal registered receipt showing that the appeal was posted to the judge in Grand Gedeh County within the time required for the filing of such bonds. As such, there was nothing counsel should have done and did not do in superintending his appeal. The motion to dismiss is therefore denied and the Clerk of this Court is ordered to re-docket this case for hearing the ensuing October Term of the Supreme Court. Costs are to abide final determination of the case. And it is so ordered.
