JUDGMENT WITHOUT OPINION

 

Decided: December 20, 1979.

 

When this case was reached on the docket, Counsellor Philip J. L. Brumskine appeared for the appellant and Counsellor Christian D. Maxwell appeared for the appellee. Appellant’s counsel called attention to the trial judge’s failure to have passed upon certain law issues when the case was heard in the lower court, and therefore requested the Court to remand the case for this purpose. With this submission, appellee’s counsel agreed and joined in the appellant’s request. It is therefore adjudged that the judgment of the trial court should be and the same is hereby reversed, and the case is remanded with instructions that the judge in the trial court passes upon all of the issues of law appearing in the pleadings.
The Clerk of this Court is ordered to send a mandate to the lower court commanding the judge therein to resume jurisdiction and give effect to this judgment. Costs to abide final determination. And it is so ordered.

 

Note: Mrs. Justice Brooks-Randolph being absent when this case was heard did not take part, hence has not signed this judgment.
