JUDGMENT WITHOUT OPINION

When this case was called for hearing, Counsellor George E. Henries appeared for the informant and informed the Court that he had filed a notice of withdrawal of the information. Counsellor J. Emmanuel R. Berry appeared for the respondent and raised no objection to the notice of withdrawal. After considering the information and the returns together with the notice of withdrawal, it is adjudged that the notice of withdraw as filed by the informant is hereby noted and the information is hereby ordered stricken from the docket with costs against the informant.
The Clerk of this Court is hereby ordered to send a mandate to the lower court to resume jurisdiction over the case and to execute this mandate. And it is hereby so ordered.
NOTE: Justice M. ICron Yangbe being absent when this case was heard did not participate in the determination of the case. Hence, he did not sign this judgment.
