KEITTEH OF KPAAI TOWN, Appellant, v. JOSEPH AUTRIDGE, Appellee.

JUDGMENT WITHOUT OPINION

Heard: November 18, 1982. Decided: February 3, 1983.

When this case was called for hearing Counselor G. Bona Segbeh appeared for appellee. Although the notice of assignment was served on the appellant, he failed to appear in person or by counsel.

Among the many statutory grounds for dismissal of an appeal is the failure of appellant to appear when the case is called, the said ground being in accordance with the Civil Procedure Law, Rev. Code 1: 51.16. The appellant having failed to appear when this case was called, either in person by counsel or both, it is hereby adjudged that the appeal be and the same is hereby dismissed. The judgment of the court below is confirmed and affirmed.

The Clerk of this Court is instructed to send a mandate to the trial court to resume jurisdiction in the matter and enforce its judgment. Costs are ruled against the appellant. And it is so ordered.

NOTE: Mr. Justice E. S. Koroma being absent due to illness when this case was called for arguments, hence did not sign this judgment.
