JUDGMENT WITHOUT OPINION

Decided: February 4, 1983

When this case was called for hearing, Counsellor Raymond A. Hoggard appeared for the appellee and called the Court’s attention to a motion filed to dismiss appellant’s appeal. No one appeared for the appellant and there was no resistance filed to the motion to dismiss. After a careful study and consideration of the motion to dismiss and the fact that the appellant did not oppose the motion or appear to prosecute his appeal, it is hereby adjudged that the motion to dismiss be, and the same is hereby granted and the appeal dismissed with costs against the appellant.

The Clerk of this Court is hereby ordered to send a mandate to the court below, commanding it to resume jurisdiction and enforce the judgment appealed from. And it is hereby so ordered.

NOTE: Chief Justice Gbalazeh being counsel for one of the parties prior to his elevation to the Bench and Justice Koroma being the trial Judge, they did not sit to finally determine this case; hence, did not sign this judgment. Associate Justice Morris being absent when the case was heard did not take part in its hearing; hence, did not also sign this judgment.
