At the call of this case for argument, Counsellor J. Emmanuel R. Berry appeared and announced representation for movant/appellee. The respondent/appellant not having appeared in person and/or by counsel, the movant/appellee prayed for the invocation of the Civil Procedure Law, Rev. Code 1:51.16. Having perused the records in this case and discovered that the defendant/appellant had failed to proceed beyond the filing of his bill of exceptions, it is hereby adjudged that the motion to dismiss the appeal be and the same is hereby granted.
The Clerk of this Court is hereby directed to send a mandate to the lower court commanding the Debt Court Judge for Montserrado County to resume jurisdiction over the case and to enforce his judgment. Costs are ruled against the appellant. And it is hereby so ordered.
