JUDGMENT WITHOUT OPINION

Decided November 22, 1984.

When this case was called for hearing, Counsellor H. Varney Sherman appeared for the appellee and gave notice that he had filed a motion to dismiss the appeal for failure on the part of appellant to proceed, citing Rev. Code 1 :51.16. Counsellor J. Emmanuel Berry appeared for the appellant and conceded the legal soundness of the motion for which he interposed no resistance. Considering the motion and the law relied upon in the absence of a resistance, it is hereby adjudged that the motion be, and the same is hereby granted. The Clerk of this Court is ordered to send a mandate to the trial court ordering the judge therein presiding to resume jurisdiction and enforce its judgment. Costs are to be paid by appellant. And it is so ordered.
