When this case was called for hearing, Counsellor John H. Mathis appeared for the appellant, and Counsellors Joseph Williamson and Lawrence R. Johnson appeared for the appellee and brought to the Court’s attention that appellee had filed a motion to dismiss the appeal. Counsel for appellant spread on the minutes that he conceded the legal soundness of the motion and therefore interposed no objection After having studied the motion, and in keeping with the law applicable thereto it is hereby adjudged that the motion to dismiss appellant’s appeal is hereby granted, with costs against the appellant.
The Clerk of this Court is hereby ordered to send a mandate to the court below to resume jurisdiction over the case and enforce its judgment. And it is hereby so ordered.
