When this case was called for hearing, Counsellor Isaac R. Malobe appeared for the plaintiff/appellee and Counsellor James D. Gordon appeared for defendant/appellant, and spread on the Court’s minutes that he conceded the legal soundness of appellee’s motion. After having studied the motion and being convinced that the grounds contained therein are supported by law, it is hereby adjudged that the motion to dismiss the appeal be, and the same is hereby granted with costs against the appellant.
The Clerk of this Court is hereby ordered to send a mandate to the court below, commanding the judge presiding therein to resume jurisdiction over the case and enforce its judgment. And it is hereby so ordered.
