THE NATIONAL SOCIAL SECURITY AND WELFARE CORPORATION, by and through its Director General, Appellant, v. THE ESTATE OF WISDOM A. G. CAESAR, Appellee.

JUDGMENT WITHOUT OPINION

Decided: July 14, 1989.

When this case was called for arguments, Counsellor Theophilus C. Gould of the Brumskine & Associates Law Firm appeared for respondent/appellant and Counsellor Joseph Williamson appeared for petitioner/appellee. Counsel for appellee informed Court that appellee had filed a motion to dismiss the appeal on the ground that appellant had failed and neglected to file an approved appeal bond as required by the Civil Procedure Law, Rev. Code 1: 51.8. After studying the motion and the laws applicable under the circumstances, it is hereby adjudged that the motion to dismiss the appeal be, and the same is hereby granted, with costs against appellant. The Clerk of this Court is hereby ordered to send a mandate to the lower court to resume jurisdiction over the case and enforce its judgment. And it is hereby so ordered.
